Excerpt from Criminology A decade has passed since my book on the applications of criminology to criminal law and procedure was published. It grew out of several years of experience with criminals in courts and prisons in this country, and criminological research in Europe. At that time it was my intention to follow that book with a Similar one on the applications of criminology to penal treatment. Since then the biological, psychological, and Social sciences upon which criminology is based have advanced rapidly, and much work has been done within the criminological field itself. Hence much Of the criminology of a decade or more ago is already obsolete. I have, therefore, abandoned my original plan, and, having commenced at the beginning of the subject, have attempted a comprehensive survey of the whole field of criminology. Much of the criminological writing heretofore has been more or less unilateral in its character. This has been due almost always to one-sided knowledge, sometimes also to prejudices and preconceived notions. For example, some writers have claimed that crime is due entirely to social causes, others have asserted that it is due entirely or almost entirely to the traits of the criminal himself. Crime, Its Causes and Remedies is a work of criminology by author and Professor of Criminal Anthropology, Cesare Lombroso. Lombroso was a professor at the Italian University of Turin, and thus all of his works were written in Italian. This book, translated by Henry P. Horton, was not released in English until after Lombroso's death. It was selected by the American Institute of Criminal Law and Criminology for translation and deemed vitally important in the understanding of crime and criminals. Part one examines the factors that contribute to crime, paying more attention to the individual than to environmental factors. Part two looks at ways in which crime can be reduced and avoided, highlighting both effective and ineffective measures that have been used. Part three applies the lessons of the first two parts to propose a detailed system for dealing with crime and criminals, from the penalties that criminals should face to the appropriate institutions they should be held in. If nothing else, Crime, Its Causes and Remedies is a case study on how far a field of science can progress in 100 years. Much of the content of this book is hopelessly out of date and many of the theories forwarded in this book would be highly controversial if presented today, including equating epileptics and criminals, and the heavy reliance on racial profiling. This book is valuable mostly for the historical insights it provides into criminology and moral attitudes rather than as a source of textbook knowledge about the subject. Many who are the loudest in condemning crime are doing all they can to protect the big criminals, seemingly unconscious of the fact that they are thus helping to produce the little ones they seem so anxious to imprison or kill. Enrico Ferri said: Three factors must be understood before we can, with any degree of clearness, understand 'criminology.' They are: First, the anthropological, that is, racial characteristics; temperaments - heredity. Second, the telluric, that is, soil, climate and natural resources, and, Third, the social institutions. He insists (and other well informed students agree) that the last exerts a much greater influence than either of the other two factors. The first and second factors furnish the material, the clay, so to speak; the third, the social institutions, become the potters who give direction to, who fashion, make or mar the human shapes, furnish language, furnish or fail to furnish labor and decide all questions of law and morals. Intellectually, morally and physically, then, these bits of anthropological and telluric clay finally reflect the work manship of the society that handles them. On the last occasion on which I had the privilege of discussing the matter with Mr. Justice Wills - it was before his retirement - he renewed his assurances of sympathy, but raised the objection that the public were not ready to sanction the indefinitely prolonged imprisonment of offenders. I urged in reply that the public would fall into line, if the Judges would adopt Sir James Fitz James Stephen's proposal that a criminal's fate should be determined only after a formal public trial on the issue of his being a professional.
