Pensato per il centenario della costituzione di Weimar (1919), questo saggio affronta il problema del fondamento delle costituzioni analizzando criticamente la genesi, le premesse ideali e i fondamenti filosofi co-politici della prima costituzione ‘normativa’ europea, collocata – tra individualismo e comunitarismo, tecnica e cultura – nel contrasto caratteristico della Germania del primo dopoguerra, erede della Bismarckzeit e inconsapevole prodromo del Terzo Reich hitleriano. In quest’ottica la costituzione di Weimar appare non soltanto una costituzione “postuma” – secondo la definizione di Carl Schmitt –, ma anche incompiuta e “patetica”, incapace di organizzare il conflitto politico diventandone anzi preda, prigioniera, specialmente nei suoi ultimi anni, di un proceduralismo incapace di decisionalità. La ricerca costituisce, così, sia un contributo alla storia del diritto costituzionale europeo, sia una critica alle ideologie giuridiche astrattamente “progressive” e promozionali, di cui la costituzione weimariana è per molti aspetti – pur nella sua ambivalenza – un modello ancora meritevole di studio proprio perché foriera di moniti sulla pericolosità epocale dell’ideologia dei diritti e del costituzionalismo puramente normativo.

A settant'anni dalla più celebre ed universale Dichiarazione dei Diritti dell'Uomo, continua ad essere urgente la necessità di semantizzarli alla luce di un'antropologia filosofica. Già, perché è proprio di umanità che parliamo quando chiamiamo in causa questi diritti, che non per essere arrivati alla positivizzazione solamente in epoca così tarda possono considerarsi un'invenzione moderna o postmoderna. L'approccio ontofenomenologico adottato in questo studio legittima la persuasione che di una struttura del giuridico si tratti, e non di una sua contingenza come orizzonte definitivo del discorso giuridico. Se è l'umanità degli uomini la cifra specifica di questi diritti, è su di essa che occorre filosoficamente interrogarsi e riflettere, anche proprio allo scopo di comprendere meglio la loro portata, i possibili contenuti e limiti, la genealogia come le applicazioni, e quindi il fondamento della loro pretesa di giustiziabilità, così audace e così spesso frustrata.

The controversial notion of social rights is situated at the heart of the relations between some key categories in the philosophical-juridical lexicon, such as equality, solidarity, citizenship and social state. The book sets out by dealing with their genesis towards the end of the eighteenth century, with particular attention to the lines of argument of Thomas Paine, to go on to examine their development, their juridical configuration and the criticisms levelled at them during the twentieth century, before arriving at basic income theories, namely alternative proposals going beyond social rights (and the juridical-constitutional forms in which they came into being). Hence, the question is dealt with up to the context of globalization and the complicated processes of European unification, also in order to single out ways to relaunch democracy itself 'from the bottom'. The underlying idea is that social rights are legitimately «fundamental» and «human rights» and that to be due they need two structural conditions: to be conceived of as «indivisible», «interdependent» and «interconnected» with respect to other fundamental rights (as ratified by the Vienna Declaration of 1993) and to be rooted contextually within a social and institutional space which today necessarily has to be multilevel but which, at the same time, does not leave aside the states' power of regulation and implementation.
