Collocata all'interno del contesto italiano ed europeo relativo alla fondazione delle scienze storiche e morali, l'opera di Amari costituisce un lucido ed erudito affresco della cultura storica, filosofica e giuridica europea del Settecento e del primo Ottocento. I suoi assi portanti sono costituiti dalla tradizione dell'illuminismo e dall'eredità vichiana interpretati in chiave metodologica e non metafisica. Il testo di Amari, come è stato notato da V. Frosini (che ha introdotto una ristampa della Critica nel 1969), si colloca all'interno della nascente Sociologia del Diritto. Per il Curatore, esso rappresenta soprattutto una delle prime voci nel Risorgimento sulla 'crisi' del giusnaturalismo verso una visione 'storicistica' del diritto. La sua valenza etica e politica consiste nella proposta di una nuova cultura per la nuova Italia, che per Amari doveva essere liberale e federalista, sul modello degli Stati Uniti d'America o della Svizzera.
