The State of the Union address is a communication between the President and Congress in which the chief executive reports on the current conditions of the United States and provides policy proposals for the upcoming legislative year. Formerly known as the "Annual Message," the State of the Union address originates in the Constitution. As part of the system of checks and balances, Article II, Section 3, clause 1 mandates that the President "shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient." In recent decades, the President has expanded his State of the Union audience, addressing the speech to both the nation and Members of Congress. Over time, the State of the Union address has evolved considerably. The format and delivery of the speech have changed, and its length has fluctuated widely. Technology has also influenced the delivery of the address, with the advent of radio, television, and the Internet playing significant roles in the transformation.

Interest in congressional oversight of intelligence has risen again in recent Congresses, in part because of disputes over reporting to Congress by intelligence community (IC) components on sensitive matters, including developments generated by the wars in Iraq and Afghanistan. The changes in the oversight structure adopted or proposed in recent Congresses, however, also reflect earlier concerns, such as increasing independent auditing authority for the Government Accountability Office (GAO) over the intelligence community, adding offices of inspectors general (OIGs), clarifying reporting requirements to Congress, and restructuring Congress's oversight mechanisms. Along these lines, the House Democratic majority had pledged in the 110th Congress to enact the remaining recommendations from the U.S. National Commission on Terrorist Attacks Upon the United States, commonly known as the 9/11 Commission. The Commission's unanimous 2004 report set the stage for a reconsideration of congressional oversight, concluding that it was "dysfunctional." The commission proposed two distinct solutions: (1) creation of a joint committee on intelligence, modeled after the defunct Joint Committee on Atomic Energy, with authority to report legislation to each chamber; or (2) enhanced status and power for the existing select committees on intelligence, by making them standing committees and granting each one both authorization and appropriations ...

Border security is a pivotal function in protecting the American people from terrorists and their instruments of destruction. This report uses a series of graphical presentations to form one possible framework that might assist policy makers in understanding the complex nature of border security. It is the first in a three-part series of CRS reports that make use of analytical frameworks to better understand complex problems in border security and cast them in terms that facilitate the consideration of alternative policies and practices. (CRS Report RL32840, Border and Transportation Security: Selected Programs and Policies, the second report in the series discusses selected programs and policies currently in place to address these issues. The third and final report in the series is CRS Report RL32841, Border and Transportation Security: Possible New Directions and Policy Options.) Border security is an important component of the overall homeland security effort. This effort can be seen as a series of concentric circles or screens, with the outer screen being that of preventative efforts launched outside the country-for example, interdicting or arresting terrorists and their weapons abroad before they reach the United States. The next screen is interdiction in the border security system.

The health of the U.S. manufacturing sector has long been of great concern to Congress. The decline in manufacturing employment since the start of the 21st century has stimulated particular congressional interest. Members have introduced hundreds of bills intended to support domestic manufacturing activity in various ways. The proponents of such measures frequently contend that the United States is by various measures falling behind other countries in manufacturing, and they argue that this relative decline can be mitigated or reversed by government policy. This report is designed to inform the debate over the health of U.S. manufacturing through a series of charts and tables that depict the position of the United States relative to other countries according to various metrics. Understanding which trends in manufacturing reflect factors that may be unique to the United States and which are related to broader changes in technology or consumer preferences may be helpful in formulating policies intended to aid firms or workers engaged in manufacturing activity. The President of the United States has available certain powers that may be exercised in the event that the nation is threatened by crisis, exigency, or emergency circumstances (other than natural disasters, war, or near-war situations). Such powers may be stated explicitly or implied by the Constitution, assumed by the Chief Executive to be permissible constitutionally, or inferred from or specified by statute. Through legislation, Congress has made a great many delegations of authority in this regard over the past 230 years. There are, however, limits and restraints upon the President in his exercise of emergency powers. With the exception of the habeas corpus clause, the Constitution makes no allowance for the suspension of any of its provisions during a national emergency. Disputes over the constitutionality or legality of the exercise of emergency powers are judicially reviewable. Both the judiciary and Congress, as co-equal branches, can restrain the executive regarding emergency powers. So can public opinion. Since 1976, the President has been subject to certain procedural formalities in utilizing some statutorily delegated emergency authority. The National Emergencies Act (50 U.S.C. §§1601-1651) eliminated or modified some statutory grants of emergency authority, required the President to formally declare the existence of a national emergency and to specify what statutory authority activated by the declaration would be used, and provided Congress a means to countermand the President's declaration and the activated authority being sought. The development of this regulatory statute and subsequent declarations of national emergency are reviewed in this report.

Since 2002, the dollar has depreciated against a broad basket of currencies and against the euro. This depreciation has prompted some observers to question whether the "cheap" dollar is leading to a "fire sale" of U.S. firms, especially of those firms that can be identified as part of the Nation's defense industrial base. Congress has displayed a long and continuing interest in foreign direct investment and its impact on the U.S. economy. Since September 11, 2001, Congress has demonstrated a heightened level of concern about the impact of foreign direct investment in critical industries or in sectors that are vital to homeland security. In the 110th Congress, Members are considering H.R. 556, the National Security Foreign Investment Reform and Strengthened Transparency Act of 2007, which was adopted by the full House on February 28, 2007. The measure reflects a heightened level of concern about the presence of foreign investors in the economy by increasing Congressional oversight over federal reviews of foreign direct investment and by expanding the current areas of review to include homeland security and critical infrastructure.
