This book examines the historical process that led to the foundation of the Italian Republic and its constitution, viewed through the personal experiences and political reflections of Adriano Olivetti (between 1919 and 1960), general manager and president of the well-known typewriter manufacturer “Ing. C. Olivetti & C.” An unbroken line of reasoning linked his maturing political reflections during the two post-war periods. The historical context of the 1950s did not prove to be very propitious, but the guidelines dispersed throughout the Italian cultural and political world from the movement that Olivetti founded were certainly seminal – generating a legacy of ideas that has only in part been recognized. What makes this study distinctive is the original approach to reading the history of Italy through Adriano Olivetti’s eyes and thoughts, far from the more common Christian Democratic or Communist perspective of those years. It is simply another view of what the Italian Republic could be and was not.

This book critically examines the conception of legal science and the nature of law developed by Hans Kelsen. It provides a single, dedicated space for a range of established European scholars to engage with the influential work of this Austrian jurist, legal philosopher, and political philosopher. The introduction provides a thematization of the Kelsenian notion of law as a legal science. Divided into six parts, the chapter contributions feature distinct levels of analysis. Overall, the structure of the book provides a sustained reflection upon central aspects of Kelsenian legal science and the nature of law. Parts one and two examine the validity of the project of Kelsenian legal science with particular reference to the social fact thesis, the notion of a science of positive law and the specifically Kelsenian concept of the basic norm (Grundnorm). The next three parts engage in a critical analysis of the relationship of Kelsenian legal science to constitutionalism, practical reason, and human rights. The last part involves an examination of the continued pertinence of Kelsenian legal science as a theory of the nature of law with a particular focus upon contemporary non-positivist theories of law. The conclusion discusses the increasing distance of contemporary theories of legal positivism from a Kelsenian notion of legal science in its consideration of the nature of law.

Il libro è proprio il racconto dei due secoli di storia del diritto amministrativo, dalle origini francesi alla sua espansione prima in tutti gli stati occidentali, poi al di fuori e al di sopra di essi. Non è ovviamente un'antologia degli innumerevoli scritti di Sabino Cassese e neanche una selezione di quelli di carattere storico: Cassese ha studiato la storia di tanti istituti, leggi e settori del diritto, ma ha raccolto in questo volume solo quelli che considerano il diritto amministrativo nel suo insieme, esaminandone i caratteri originari e l'evoluzione, delimitandone i confini, comparandolo con altre branche del diritto, descrivendone le varianti nei diversi contesti nazionali e internazionali, valutando lo stato delle diverse scienze amministrative. Si tratta di scritti pubblicati negli ultimi venti anni: tra essi, alcuni degli studi che, pur beneficiando delle ricerche condotte in precedenza, hanno maggiormente impegnato Cassese nel corso degli anni Novanta. Essi devono allora interrogarsi sulla perdurante attualità della loro offerta. Il metodo tradizionale è ancora quello che può dare i risultati migliori? I contenuti dei vari insegnamenti sono ancora adeguati? Si presta la necessaria attenzione al linguaggio utilizzato? È meglio accentuare ancora i profili professionalizzanti o è piuttosto il caso di puntare su una formazione meno legata al dato normativo spicciolo e invece più improntata a formare intelligenze vive, culturalmente preparate ai casi sempre nuovi della vita reale e ai problemi che ancora non hanno trovato una disciplina definita?
