La presente obra, compleja, se estructura del modo siguiente: En primer lugar, el profesor cubano Leonardo Pérez Gallardo, plantea una aproximación a lo que haya de entenderse por cultura popular, haciendo referencia al individuo, a la sociedad y al Estado como partícipes y destinatarios de la misma. Acto seguido, la profesora burgalesa Raquel de Román se ocupa de estudiar las manifestaciones de la cultura popular relevantes como auténticas obras del espíritu, prestando atención particular, en esta sede, a la tapicería, al folclore y a los cuentos y tradiciones populares. Sabido ya lo anterior, Carlos Rogel, de la Complutense de Madrid, se ocupa de reflexionar sobre la autoría de las obras incardinadas en la cultura popular, fijando la atención en las obras de autores ciertos, aunque no sean notorios, en las de autores anónimos o que utilicen seudónimos, en las obras de autoría plural y en las obras, en fin, cuyo autor sea desconocido. Abel Martín, de la Complutense también, cierra la teoría general del tema objeto de estudio analizando los derechos correspondientes a los autores de las obras procedentes de la cultura popular y la legitimación para el ejercicio de los mismos. Acto seguido y rompiendo el fuego del estudio de las legislaciones sobre el tema, la profesora Nancy Ojeda, de la Universidad de La Habana, estudia el asunto en los tratados y acuerdos internacionales. Después, Isabel Espín, de la Universidad de Santiago de Compostela, se ocupa de la cuestión en la legislación española, prestando atención preferente a la artesanía. Más tarde, la profesora cubana Caridad Valdés, afronta el análisis de la legislación cubana al respecto, con atención preferente prestada a la música. A mayor abundamiento, los profesores Miguel Encabo —de la Universidad de Extremadura—, Rafael Roselló —de la Universidad de La Habana—, Ivonne Sleman —que fue asesora jurídica del Instituto Nacional de Derecho de Autor de México— y Víctor Drummond —que enseña en Río de Janeiro— traen a colación, desde una perspectiva práctica, temas y asuntos curiosos de la cultura popular de sus respectivos países y de muchos otros también. A renglón seguido, Ernesto Vila pone de relieve el papel posible del Estado en la cultura popular y los esfuerzos hechos por el Centro Nacional de Derecho de Autor de Cuba —del que es director— en la difusión de la cultura popular. La obra finaliza con una referencia enriquecedora a cuestiones penales y procesales relacionadas con la cultura popular. El profesor Juan Mendoza, de la Universidad de La Habana, habla, en efecto y al respecto, sobre acciones, procedimientos y medidas cautelares, en tanto que la profesora Mayda Goite, de la misma Universidad, se ocupó de faltas, delitos y penas. This book focuses on the fraught relationship between cultural heritage and intellectual property, in their common concern with the creative arts. The competing discourses in international legal instruments around copyright and intangible cultural heritage are the most obvious manifestation of this troubled encounter. However, this characterization of the relationship between intellectual and cultural property is in itself problematic, not least because it reflects a fossilized concept of heritage, divided between things that are fixed and moveable, tangible and intangible. Instead the book maintains that heritage should be conceived as part of a dynamic and mutually constitutive process of community formation. It argues, therefore, for a critically important distinction between the fundamentally different concepts of not only intellectual and cultural heritage/property, but also of the market and the community. For while copyright as a private property right locates all relationships in the context of the market, the context of cultural heritage relationships is the community, of which the market forms a part but does not – and, indeed, should not – control the whole. The concept of cultural property/heritage, then, is a way of resisting the reduction of everything to its value in the market, a way of resisting the commodification, and creeping propertization, of everything. And, as such, the book proposes an alternative basis for expressing and controlling value according to the norms and identity of a community, and not according to the market value of private property rights. An important and original intervention, this book will appeal to academics and practitioners in both intellectual property and the arts, as well as legal and cultural theorists with interests in this area.
