Cultura (Sintesi della legislazione dell'UE) 2018L'articolo 167 del trattato sul funzionamento dell'Unione europea (UE) definisce il ruolo della stessa nel campo della cultura: l'Unione sostiene, coordina o integra le azioni dei paesi membri e mira a portare in primo piano il patrimonio culturale comune dell'Europa. L'UE sostiene le azioni volte alla conservazione del patrimonio culturale e promuove la cooperazione e gli scambi transnazionali fra istituzioni culturali nei paesi membri. Dal 2014 al 2020 sarà attivo il nuovo programma di finanziamento «Europa creativa». Altre iniziative sono le «Giornate europee del patrimonio» (iniziative locali che permettono l'accesso a siti normalmente non aperti al pubblico) e «Capitali della cultura», lanciate entrambe nel 1985. L'UE lavora anche con altre organizzazioni internazionali, per affrontare questioni come il traffico di beni culturali.

Prefazione di Emma Bonino Europa contro porta l’attenzione sugli ostacoli che si frappongono ad un futuro condiviso dell’Unione europea e prende le mosse da tre interrogativi che gli autori si sono posti: perché non se ne può fare a meno? Come la si può rimettere in corsa con soluzioni praticabili in tempi ravvicinati? Come superare la emergente dicotomia dell’Europa contro molti e di molti contro essa? Nella prima parte, L’Europa tra idealità e necessità, si affronta l’aspetto politico. Si esamina la genesi e lo sviluppo della IV Rivoluzione industriale: dalle tecnologie digitali, alla finanziarizzazione dell’economia e liberalizzazione degli scambi commerciali. Gli effetti di questa trasformazione toccano le condizioni di vita di milioni di persone e le loro aspettative, divenute decrescenti dopo essere state percepite per decenni come crescenti. Disorientamento, paura e sfiducia si coniugano oggi con l’affidamento a partiti e movimenti politici che propongono la chiusura nei confini nazionali ed il depotenziamento delle Istituzioni sovranazionali, in primis dell’Unione europea. Deriva azzardata e pericolosa, perché l’attuale Ordine mondiale multipolare è caratterizzato da tre preponderanti attori (Stati Uniti, Russia, Cina) in competizione tra loro per la ridefinizione delle aree geografiche d’influenza. In questo contesto, un forte interlocutore europeo garantirebbe prospettive di pace, governabilità della IV Rivoluzione industriale e sviluppo condiviso. Nella seconda parte, L’Europa incompiuta, si analizza l’assetto istituzionale dell’Unione per individuare le cause dell’attuale stallo della UE. Viene affrontata l’esigenza di dotare l’Unione europea di una comprensibile ed agile Costituzione, per stabilire le regole del gioco democratico di un popolo europeo con il diritto di essere pienamente sovrano. Il processo storico della costituzionalizzazione dei princìpi che regolano i Trattati europei è particolarmente complesso e rappresenta finora un’opera incompleta e poco conosciuta, sebbene abbia concorso al passaggio da un’Europa essenzialmente mercantile ad un’Europa fondata sui diritti. Una formale Costituzione europea rappresenterebbe anche la migliore difesa delle autonomie locali, dello stato di diritto, della libertà e della giustizia sociale in tutti gli Stati membri. Inoltre, il processo costituente e di riaggregazione della UE con soluzioni innovative potrebbe rappresentare il punto d’incontro di tutte le anime della vicenda europea, anche quelle ora antagoniste, e avvicinare i cittadini alle Istituzioni eurounitarie. Nel silenzio attuale sulla rilevanza dell’esperienza dell’Unione europea, le due parti del libro, politica ed istituzionale, consentono di comprendere l’importanza anche per il quotidiano di ciascun europeo dell’evoluzione transnazionale e democratica della UE.

"More than 30 years have elapsed since Robert Schuman's declaration of 9 May 1950 and the signature on 18 April 1951 of the Treaty of Paris establishing the European Coal and Steel Community. The time has come for the European Community to take stock. Both as a unique economic and human experiment, and as a reality endowed with powerful legal instruments, this singular phenomenon needs to be examined from the standpoint of history. The establishment of the Community was completed with the conclusion of the Treaties of Rome creating the European Economic Community and the European Atomic Energy Community. Its institutions have undergone several stages of development, including the merger of the executives, the creation of own resources, the extension of Parliament's budgetary powers and the creation of a Court of Auditors. At the same time the Community was putting into effect the fundamental principles of free movement of goods, persons, services and capital, and developing the common policies which are laid down in the Treaties or which proved necessary in order to attain, in the course of the operation of the common market, one of the objectives of the Community. On two occasions it has been enlarged by the accession of further European States, first Denmark, Ireland and the United Kingdom, and subsequently Greece. It has also commenced negotiations with a view to the admission of Spain and Portugal. The progress made by the Community is reflected in a vast range of legislation binding on Member States, firms and individuals, and in the body of case-law built up by the Court of Justice in Luxembourg. Despite nearly sixty years of European integration, neither nations nor national loyalties have withered away. On the contrary, national identity rhetoric seems on the rise, not only in politics but also in legal discourse. Lately we have seen a rise in the number of Member States invoking their national identity in an attempt to justify a derogation from a requirement imposed on them by a Treaty article or an EU legislative act, or to legitimize a particular national reading of such an EU norm. Despite this, the European Court of Justice (ECJ) has yet to develop a coherent approach to such arguments, or express a vision of the role national identity should play in EU law. Elke Cloots undertakes this task by providing a principled and coherent scheme for the adjudication of disputes involving claims based on the national identity of a Member State. Should arguments involving national identity be legally relevant? If yes, how should the ECJ approach such identity-related interests? Cloots crafts a normative framework to assist the ECJ in striking the right balance between European integration and respect for the identity concerns at issue.
