Analyses how bankruptcy was litigated within the court to gain a more nuanced understanding of early modern bankruptcy. This book examines cases involving bankruptcy brought before the court of Chancery - a court of equity which dealt with civil disputes - between 1674 and 1750. It uncovers the numerous meanings attached to financial failure in early modern England. In its simplest sense, personal financial failure occurred when an individual defaulted on their debts. Because they had not fulfilled their responsibilities and behaved in a trustworthy and credible manner, bankrupt individuals were seen to be immoral. And yet bankruptcy was linked to wider notions of credibility, trustworthiness, and morality. Financial failure was described and debated not just in economic terms, but came to rely on a combination of social, community, and religious values. Bankruptcy cases involved an interconnected network of indebtedness, often including relatives, neighbours, and traders from the local community. As such, conceptions of failure implicated individuals beyond just the bankrupt. As people began to look back and appraise the actions and words of those involved in trade, a far wider network of creditors, debtors, and middlemen were blamed for the knock-on effect of an individual failure. Ultimately, the book investigates the negative aspects of early modern trade networks and the active role of the court when such networks broke down, providing unique access to contemporary understandings of what was considered right and wrong, honourable and deceitful, and criminal and compassionate within the moral landscape of debt recovery during the seventeenth and eighteenth centuries.

Victims and Criminal Justice is the first study of its kind to examine both the origins and impacts of key legal, procedural, and institutional changes introduced in England and Wales to encourage and govern prosecution. It sets out how crime victims' experiences of, and engagement with, the process of criminal justice changed dramatically between the late seventeenth and late twentieth centuries. Where victims once drove the English criminal justice system, bringing prosecutions as complainants and prosecutors, giving evidence as witnesses, putting up personal rewards for the recovery of lost goods or claim rewards for securing convictions, by the end of this period, victims had been firmly displaced as the state took virtually full responsibility for the process of prosecution. Combining qualitative analysis of a range of textual sources with quantitative analysis of large datasets featuring over 200,000 criminal prosecutions, the authors explore how victims were defined in law, what the law allowed and encouraged them to do, who they were in social and economic terms, how they participated in the criminal justice system, why many were unwilling or unable to engage in that system, and why some campaigned for specific rights. Imprisonment was rarely used as punishment in Britain before 1800. The criminal justice system was based on terror and deterrence, sentencing convicts to the gallows at home and transportation overseas, with prisons serving primarily as holding spaces for the accused until the case against them was resolved. A major shift began in the late eighteenth century when imprisonment became an end in itself: a means to reform as well as to discipline criminal offenders. To Detain or to Punish revisits this revolutionary moment as it played out in the metropolis of London. Kiran Mehta charts how Londoners, through their interactions with police, magistrates, and judges, became prisoners, and then follows them into the prison, revealing how these institutions were managed and experienced. Local authorities’ increased use of imprisonment, for punishment as well as for detention, sparked the wholesale reconstruction and redesign of London’s prison estate. It also spurred the consolidation of the modern notion that prisoners who had not yet been convicted of a crime, or who had not been sentenced to imprisonment, should be held separately from and treated differently to those incarcerated for punishment. Most notably, the requirement to labour became a distinguishing feature of punitive confinement. Challenging traditional ideas about who and what prisons were for and how they operated, To Detain or to Punish offers a radical reappraisal of London’s prison system between 1750 and 1840.
