The battle is about market shares in the rapidly growing market of mobile phones in the PRC. Mobile phones, or in chinese “Shouji”1, become increasingly popula r, especially in the so-called boom-areas where mobile phones have become a status symbol like in other western countries so that people own 2 or 3 or even more mobiles whereas in rural areas the development of mobile communication networks still goes ofte n against zero. The purpose of this essay is to show up some facts about the PRC ́s telecommunication market, to introduce the reader to the most important foreign and domestic companies doing business in this market, to show up the current situation of both types of companies in China, and to analyse some reasons for the recent market development. This book analyses and critically evaluates the development of two key components of China’s economy: the network of productive enterprises, and the national innovation system, from the inception of market-oriented reforms to the present day. The approach is a partly novel one, albeit inspired to classical political economy, rooted in the structure and evolution of social relations of production and exchange and of the institutional setting in these two crucial domains. The main findings are twofold: First, the role of planning and public ownership, far from withering, has being upheld and qualitatively enhanced, especially throughout the most recent stages of industrial reforms. Second, enterprises are increasingly participating - along with universities and research centers - in a concerted and historically unparalleled effort to dramatically upgrade China’s capacity to engage in indigenous innovation. As a result, China’s National Innovation System has been growing and strengthening at a pace much faster than that of the national economy as a whole. The book also presents a speculative and provisional perspective on the validity, and meaning, of the claim that the country’s socioeconomic system is indeed a form of socialism with Chinese characteristics. It will be on interest to students and scholars researching China, politics, and development economics.

The 2003 Special Issue of the Comparative Law Yearbook of International Business deals with issues relating to Corporate Governance. Following a series of scandals involving reporting by public companies in the United States, there has been an increase in the number of measures dealing with, among other things, the liability of directors and managers when submitting company financial returns. The first and most well-known piece of legislation to be introduced was, of course, the United States Sarbanes-Oxley Act of 2002. The Sarbanes-Oxley Act covers matters including the establishment of audit committees, disclosure committees, and codes of ethics, with an emphasis upon the disclosure of information and transparency. It describes, for example, the principle of ¿vicinity of Insolvency¿ and the relevant information to be disclosed to shareholders and creditors. The issue of directors¿ duties and responsibilities is addressed, together with the consequences of insider trading and conflicts of interests. The Act also contains provisions on whistleblowers and introduces new criminal sanctions for company wrongdoings, as well as enhancing those penalties already in place. As a result of the Sarbanes-Oxley Act, many countries have followed suit and adopted their own measures to combat corporate failings, corruption, and the misuse of power. Among those covered in this publication are South Africa, China, a number of eastern and western European states, and various Asian jurisdictions.
