Customary Law Ascertained Volume 3 is the third of a three-volume series in which traditional authorities in Namibia present the customary laws of their communities. It contains the laws of the Nama, Ovaherero, Ovambanderu, and San communities. Volume 2 contained the customary laws of the Bakgalagari, the Batswana ba Namibia and the Damara communities. Recognised traditional authorities in Namibia are expected to ascertain the customary law applicable in their respective communities after consultation with the members of that community, and to note the most important aspect of such law in written form. This series is the result of that process, It has been facilitated but the Human Rights and Documentation Centre of the University of Namibia, through the former Dean of the Law Faculty, Professor Manfred Hinz.

The Ministry of Regional and Local Government, Housing and Rural Development, and the Council of Traditional Leaders therefore initiated the ascertainment of customary law. The ascertainment project is housed in the Human Rights and Documentation Centre of the University of Namibia. The former Dean of the Faculty of Law of the University of Namibia, Professor Manfred O. Hinz, has directed the project since its inception.

This book draws on concrete cases of collaboration between anthropologists and legal practitioners to critically assess the use of anthropological expertise in a variety of legal contexts from the point of view of the anthropologist as well as of the decision-maker or legal practitioner. The contributions, several of which are co-authored by anthropologist–legal practitioner tandems, deal with the roles of and relationships between anthropologists and legal professionals, which are often collaborative, interdisciplinary, and complementary. Such interactions go far beyond courts and litigation into areas of law that might be called ‘social justice activism’. They also entail close collaboration with the people –often subjects of violence and dispossession –with whom the anthropologists and legal practitioners are working. The aim of this collection is to draw on past experiences to come up with practical methodological suggestions for facilitating this interaction and collaboration and for enhancing the efficacy of the use of anthropological expertise in legal contexts. When the notion of ‘alternative facts’ and the alleged dawning of a ‘postfactual’ world entered public discourse, social anthropologists found themselves in unexpectedly familiar territory. In theirempirical experience, fact—knowledge accepted as true—derives its salience from social mechanisms of legitimization, thereby demonstrating a deep interconnection with power and authority. In thisperspective, fact is a continually contested and volatile social category. Due to the specific histories of their colonial and post-independence experience, African societies offer a particularly broad array of insights into social processes of juxtaposition, opposition, and even outright competition between different postulated authorities. The contributions to the present volume explore the variety of ways in which authority is contested in Southern and Eastern Africa, investigating localized discourses on which institution, what kind of knowledge, or whose expertise is accepted as authoritative, thus highlighting the specificities and pluralities in ‘modern’ societies. This edited volume engages with larger theoretical questions regarding power and authority in the context of (post)colonial states (neo)traditional authority, claiming space, conflict and (in)justice, and contestations of knowledge. It offers in-depth critical analyses of ethnographic data that put contemporary African phenomena on equal footing with current controversies in North America, Europe, and other global settings.

This book sets forth the evolution of Korea's law and legal system from the Chosǒn dynasty through the colonial and postcolonial modern periods. This is the first book in English that comprehensively studies Korean legal history in comparison with European legal history, with particular emphasis on customary law. Korea's passage to Romano-German civil law under Japanese rule marked a drastic departure from its indigenous legal tradition. The transplantation of modern civil law in Korea was facilitated by Japanese colonial jurists who created a Korean customary law; this constructed customary law served as an intermediary regime between tradition and the demands of modern law. The transformation of Korean law by the forces of Westernisation points to new interpretations of colonial history and presents an intriguing case for investigating the spread of law on a global level. In-depth discussions of French customary law and Japanese legal history also provide a solid conceptual framework suitable for comparing European and East Asian legal traditions.

Thinking Blue/Writing Red interrogates contemporary culture across a range of texts, from the pandemic (‘Covid’ and ‘Trump Speak’) to high theory (Melville's narratives) and popular culture (Beyoncé's ‘Formation’ and Super Bowl performance, Twin Peaks , metamodern ‘cli-fi’ films). Inspired by Derrida’s idea of the secret, Tumino examines the significance of social movements (Black Lives Matter, Occupy, alter-globalization) and naïve art (Darger, Ryden) to argue that these texts speak of the secrets that capitalism cannot speak. Contending that the cultural surfaces narrate only the ‘nonsecret,’ that to see the social logic of the culture one must dig into what Bruno Latour questions as the ‘deep dark below,’ Thinking Blue/Writing Red reads these texts to tease out the underlying narratives of the culture of capital.
