Organisierte Kriminalität und Terrorismus sind gemeinsame Probleme ohne gemeinsame Definition. Die Internationalisierung der beiden Probleme und ihrer hybriden Formen betrifft Deutschland ebenso wie China. Organized crime, terrorism and hybrid forms of both are internationalized problems, affecting Germany as much as China. It is important to find solutions working for both sides without compromising social and political values. Since both countries differ in their normative preconditions and institutional setup, such a common response is difficult to reach. Differences in material criminal law as well as in criminal procedure law are obvious. Further frictions arise from constitutional and institutional aspects. Still, the authors engage in a common analysis of related phenomena and do not refrain from criticizing deficiencies in existing normative and institutional structures. This enables the reader to realize differences and to learn about possibilities for common action.

Criminal law can no longer be neatly categorised as the product and responsibility of domestic law. That this is true is emphasised by the ever-increasing amount of legislation stemming from the European Union (EU) which impacts, both directly and indirectly, on the criminal law. The involvement of the EU institutions in the substantive criminal laws of its Member States is of considerable legal and political significance. This book deals with the emerging EU framework for creating, harmonising and ensuring the application of EU criminal law. This book aims to highlight some of the consequences of EU involvement in the criminal law by examining the provisions which have been adopted in the field of information and communications technology. It provides an overview of the criminal law competence of the EU and evaluates the impact of these developments on the criminal laws of the Member States. It then goes on to consider the EU legislation which requires Member States to regulate matters such as data protection, e-security, intellectual property and various types of illegal content through the criminal law is analysed. In the course of this evaluation, particular consideration is given to issues such as the basis on which the EU institutions establish the need for criminal sanctions, the liability of service providers and the extent to which the Member States have adhered to, or departed from, the legislation in the course of implementation.

Der neue Band 2020/21 setzt sich direkt mit den schärfsten Grundrechtseinschränkungen in der Geschichte der Bundesrepublik durch den Pandemie-Notstand auseinander.1 Als wir vor rund zwanzig Jahren, kurz nach dem "11. September", ein "Jahrbuch" für "Öffentliche Sicherheit" beschlossen, war uns zwar klar, dass "Sicherheit" Konjunktur haben wird, aber in diesem Ausmaß ahnten wir das natürlich nicht – von "Corona" ganz zu schweigen. Inzwischen ist das Thema "Sicherheit" regelrecht "explodiert", sodass auch in den großen sozial- und rechtswissenschaftlichen Fachverlagen eigene Reihen und z. T. neue Zeitschriften entstanden sind. Da das JBÖS hier "früh" unterwegs war, hat es sich rasch ganz ordentlich etablieren können und wurde bald auch über den Sicherheitsdiskurs i. e. S. hinaus als "wichtiges politik- und rechtswissenschaftliches Forum zur Erörterung demokratiepolitischer und sicherheitsrelevanter Fragen" angesehen.2 So lag es schließlich nahe, den Leserkreis noch breiter aufzustellen und seit 2016/17 über unseren Hausverlag für Polizeiwissenschaft hinaus das JBÖS in Kooperation mit dem Nomos-Verlag zu publizieren.

Das deutsche Strafrecht ist weltweit rezipiert worden. Über Japan gelangte es nach Südkorea und Taiwan und von dort nach China; das chinesische Strafgesetzbuch von 1997 ist sehr stark dem deutschen Vorbild verpflichtet. Dasselbe gilt für das neue türkische Strafgesetzbuch von 2005. Spanien und die Länder Südamerikas haben ebenfalls deutsches Strafrecht rezipiert. In allen genannten Ländern orientiert sich auch die Strafrechtswissenschaft mehr oder weniger stark am deutschen Modell. Aufsätze und Lehrwerke aus Deutschland werden übersetzt; es finden zahlreiche gemeinsame Tagungen statt und viele Doktoranden aus den genannten Ländern reisen nach Deutschland, um hier ihre wissenschaftliche Schulung zu erhalten.
