O instituto da prescrição não encontra, na seara do controle externo, o regramento normativo necessário e suficiente para sua aplicação (ou não aplicação) e para a concretização de seu objetivo de estabilização das relações jurídicas. E os reflexos dessa insuficiência se fazem sentir no próprio exercício dessa função estatal, de estatura constitucional, a cargo das Cortes especializadas, por sua vez dotadas de autonomia e independência, na arquitetura republicana. Desta feita, as reflexões contidas nesta obra se desdobram em duas dimensões, as quais exigem o desempenho de duas tarefas correlatas pelo intérprete e aplicador do direito quanto ao tema, a saber: a) a interpretação da regra constitucional quanto às pretensões e ações imprescritíveis, tendo por baliza incontornável a atual jurisprudência do Supremo Tribunal Federal; e b) a integração da lacuna normativa (quando existente) quanto às pretensões e ações prescritíveis, fornecendo subsídios argumentativos que propiciem aos Tribunais de Contas quer a propositura de lei quanto ao tema, quer a normatização interna, quer mesmo a adaptação de seu entendimento jurisprudencial.
