Se nel passato una disponibilità di risorse apparentemente illimitata ha consentito di accantonare alcune questioni cruciali, oggi che l’umanità ha oltrepassato la soglia del sovraccarico ecologico globale, la pretesa di incidere sulla vita del suolo significa contribuire a mettere a rischio il pianeta e perciò a ledere un interesse che corrisponde a esigenze profondamente avvertite nel tessuto sociale e che trova la sua tutela nelle Carte costituzionali della nostra epoca.Nella riflessione sottesa a questo studio il suolo rileva non soltanto sul piano economico – come sembrerebbe potersi dedurre dalla storia dell’istituto della proprietà terriera e dalla sua collocazione nella Costituzione all’interno dei “rapporti economici” –, ma anche su quel piano ideale dove esso è sintesi di valori che rinviano a diritti fondamentali.Le finalità indicate dall’art. 44 Cost. si aprono così a nuove ipotesi di lettura, in termini di conservazione del suolo per consentirne il godimento nel presente e nel futuro, nonché di tutela di altri interessi per la cui soddisfazione si rende necessaria un’equa distribuzione non già della proprietà terriera, ma dell’accesso alla fruizione.
