Mit dem Inkrafttreten der EuInsVO am 31. Mai 2002 haben die europäischen Mitgliedstaaten erstmals eine verbindliche Vorgabe für die Koordination und Gestaltung grenzüberschreitender Insolvenzverfahren erhalten. Es besteht nunmehr eine gemeinsame Basis zur Beantwortung der drei klassischen Fragen des Internationalen Insolvenzrechts: die Bestimmung der internationalen Zuständigkeit, die Abgrenzung der räumlichen Wirkungserstreckung eines im Inland eröffneten Insolvenzverfahrens und die Voraussetzungen für die Anerkennung der Wirkungen eines im Ausland eröffneten Insolvenzverfahrens im Inland. Gleichwohl besteht in wesentlichen Punkten noch eine Diskrepanz zwischen den Anforderungen der europäischen Insolvenzrealität und dem Regelungskonzept der EuInsVO. Die vorliegende Untersuchung stellt dar, welche Probleme konkret die Sanierung europaweit operierender Unternehmen und Konzerne in der Insolvenz in der Praxis bereitet, und widmet sich der Frage, ob diese Probleme wenn nicht allein durch die Praxis, so durch die nationalen Gesetzgeber im Sinne einer Fortbildung der durch die EuInsVO angestoßenen Entwicklung eines "europäischen Insolvenzrechts" im Wege der Konvergenz gelöst werden können. Nur durch Vergleich unterschiedlicher europäischer Rechtsordnungen lässt sich die Existenz oder die Möglichkeit derartiger Konvergenzbewegungen feststellen. Die Insolvenzrechtssysteme Deutschlands, Österreichs, Englands und Spaniens mit ihren jeweils unterschiedlichen Hintergründen werden für diesen Vergleich herangezogen. Schließlich wird dargelegt, in welcher Weise die EuInsVO und die nationalen Rechte nachreguliert werden sollten, um den Insolvenzpraktikern geeignete Instrumente und Mechanismen für die Bewältigung grenzüberschreitender Unternehmensinsolvenzen an die Hand zu geben.
