Kommunale Fachhochschule für Verwaltung in Niedersachsen, Sprache: Deutsch, Abstract: Ziel dieser Arbeit ist es, zu untersuchen, ob die Regelungen des kürzlich beschlossenen Masernschutzgesetzes mit dem Grundgesetz vereinbar sind oder ob tatsächlich die Grundrechte der von der Masernimpfpflicht betroffenen Personen verletzt werden. Durch die Einführung einer gesetzlichen Impfpflicht werden gleich mehrere Grundrechte tangiert. Beim Impfen als medizinische Maßnahme ist allen voran das Recht auf körperliche Unversehrtheit aus Art. 2 Abs. 2 S.1 Grundgesetz (GG) betroffen. Dieses Grundrecht soll daher im Zentrum der Betrachtung stehen und einer umfangreichen verfassungsrechtlichen Prüfung unterzogen werden. Alle anderen betroffenen Grundrechte wie unter anderem das Recht auf Berufsfreiheit und das elterliche Erziehungsrecht sollen anschließend nur in gebotener Kürze, ohne weitergehende Prüfung dargestellt werden, da sich zwischen den einzelnen Grundrechten sehr viele Überschneidungen ergeben. In den vergangenen Jahren ist die Debatte um die Einführung einer Impfpflicht für die Masernerkrankung immer weiter hochgekocht. Befürworter einer Impfpflicht behaupten zum Beispiel, dass es in Deutschland wieder vermehrt zu Masernausbrüchen komme, da sich immer weniger Menschen impfen lassen würden und sogar vermehrt Jugendliche und Erwachsene an der oft als harmlose Kinderkrankheit abgestempelten Krankheit erkranken. Auf der anderen Seite hört und liest man von Impfgegnern immer häufiger, Impfungen seien unsicher, nicht notwendig und haben schwerwiegende Nebenwirkungen. Regelrechte Verschwörungstheorien kursieren diesbezüglich im Internet. Die Bundesregierung hat auf diese kontroverse Diskussion nun mit der Einführung einer Impfpflicht für Masern in Gestalt des Gesetzes für den Schutz vor Masern und zur Stär
