Stephanie Madeleine Bialluch ameliorates the situation by analysing and classifying bondholder representation in view of Germany's securities and general civil law, but particularly its law of obligations. Furthermore, she explores the controversially discussed options for terminating bonds. German description: Das Schuldverschreibungsgesetz verbindet die Glaubiger von Anleihen zu einer besonderen Gemeinschaft. Wie dieses Kollektiv und die Bestimmungen des Schuldverschreibungsgesetzes einzuordnen sind, ist bisher nicht abschliessend geklart. Welche Moglichkeiten bestehen fur den einzelnen Anleiheglaubiger, sich durch Kundigung vorzeitig von seinem Investment und diesem Kollektiv zu losen? Ausgehend von den bilateralen Rechtsbeziehungen zwischen dem Anleiheschuldner und dem einzelnen Anleiheglaubiger werden das Kollektiv der Anleiheglaubiger sowie die Bestimmungen des Schuldverschreibungsgesetzes anhand der wertpapierrechtlichen und allgemeinen zivilrechtlichen, insbesondere schuldrechtlichen, Grundlagen analysiert und qualifiziert. Anschliessend untersucht die Autorin, welche Moglichkeiten fur den Glaubiger einer Anleihe bestehen, diese zu kundigen, und welche Moglichkeiten wiederum fur das Kollektiv der Anleiheglaubiger bestehen, eine solche Kundigung aufzuheben.

1. 1 Die Wertpapierarten Hoffnungswerte sind bisher ungeregelte, deutsche Wertpapiere, resultierend aus der Zeit vor 1945. Hoffnungswerte verbriefen in Wertpapierform ungeregelte Gläubiger- und Ver mögensansprüche gegenüber Schuldnern mit Sitz oder Vermögen auf dem Gebiet der ehe maligen Deutschen Demokratischen Republik bzw. auf ehemaligen deutschen Gebieten östlich der Oder-Neiße-Linie sowie gegenüber öffentlich-rechtlichen oder privaten Schuld nern in der Bundesrepublik Deutschland und in West-Berlin. Diese ungeregelten Ansprü che aus festverzinslichen Wertpapieren oder Aktien bzw. Anteilscheinen können nach der 1990 erfolgten Wiedervereinigung unter bestimmten Umständen zu Entschädigungen füh ren. Im wesentlichen sind bei den Hoffnungswerten folgende Wertpapierarten zu unterschei den: - die Schattenquoten-Bezugsscheine aus dem Londoner Schuldenabkommen von 1953 zur Ablösung von rückständigen Zinsen aus Fremdwährungs-Anleihen des ehemaligen Deutschen Reiches, ausgegeben von der Bundesrepublik Deutschland von 1953 bis 1979, - die Fremdwährungs-Anleihen mittel-und ostdeutscher Emittenten, die 1945 notleidend wurden und bis heute ungeregelt sind, - die vor 1945 in Reichsmark emittierten Anleihen und Schatzanweisungen des Deut schen Reichs und seiner Sondervermögen, - die vor 1945 emittierten Goldmark- oder Reichsmark-Anleihen mittel- und ostdeut scher Länder, Provinzen und Städte (Anleihen, Ablösungsanleihen), - die unbedienten oder quotal bedienten Pfandbriefe und Kommunal-Schuldverschrei bungen von Berliner Altbanken und verlagerten, mitteldeutschen Geldinstituten (soge nannte A- und C-Ansprüche), - die Pfandbriefe und Kommunal-Schuldverschreibungen von mittel- und ostdeutschen Geldinstituten, - die Reichsmark-Anleihen privater, überwiegend mittel- und ostdeutscher Emittenten, die 1945 notleidend wurden und bis heute unbedient sind bzw.
