Diplomarbeit aus dem Jahr 2008 im Fachbereich Organisation und Verwaltung - Sonstiges, Note: 2,0, Universität Potsdam, Sprache: Deutsch, Abstract: In den Fokus europäischer Wettbewerbspolitik geriet in den letzten Jahren verstärkt auch ein Bereich, welcher traditionell in die Verantwortung der Mitgliedsstaaten fällt: Die Daseinsvorsorge. Gemeint sind hiermit, grob beschrieben, Leistungen wie die Wasserversorgung oder der öffentliche Personennahverkehr (ÖPNV), welche in Deutschland traditionell die Kommunen den Bürgern bereitstellen und so einen immensen Beitrag zum Allgemeinwohl leisten. Überwiegend werden diese Leistungen durch kommunale Unternehmen, sei es in öffentlich-rechtlicher Form, in Privatrechtsform oder in gemischtwirtschaftlicher Form, erbracht. Daseinsvorsorgeleistungen gelten allgemein als der substanziellen Kernbestand der kommunalen Selbstverwaltung, welche den deutschen Kommunen durch Art. 28 Abs. 2 GG ausdrücklich zugesichert wird. Der fortschreitende Prozess der europäischen Integration wirkt jedoch in vielfältiger Weise immer stärker auf die kommunale Selbstverwaltung und die kommunale Daseinsvorsor-ge einschließlich ihrer Wahrnehmung durch kommunale Unternehmen rechtlich und tat-sächlich ein. Auf der einen Seite steht also die EU, namentlich in Gestalt der Kommission und des Europäischen Gerichtshofs (EuGH), welche in der traditionellen deutschen Organisation und Finanzierung von Daseinsvorsorgeleistungen eine Gefahr für den europäischen Binnenmarkt ohne Wettbewerbsbeschränkungen befürchten. Auf der anderen Seite se-hen sich die deutschen Kommunen immer öfter durch EU-rechtliche Vorgaben in ihrer Organisationshoheit beschnitten und argumentieren nicht selten mit dem ihnen zuge-sagten Recht auf kommunale Selbstverwaltung durch das Grundgesetz (GG) sowie dem Subsidiaritätsprinzip. Michael Ignatieff draws on his extensive experience as a writer and commentator on world affairs to present a penetrating account of the successes, failures, and prospects of the human rights revolution. Since the United Nations adopted the Universal Declaration of Human Rights in 1948, this revolution has brought the world moral progress and broken the nation-state's monopoly on the conduct of international affairs. But it has also faced challenges. Ignatieff argues that human rights activists have rightly drawn criticism from Asia, the Islamic world, and within the West itself for being overambitious and unwilling to accept limits. It is now time, he writes, for activists to embrace a more modest agenda and to reestablish the balance between the rights of states and the rights of citizens. Ignatieff begins by examining the politics of human rights, assessing when it is appropriate to use the fact of human rights abuse to justify intervention in other countries. He then explores the ideas that underpin human rights, warning that human rights must not become an idolatry. In the spirit of Isaiah Berlin, he argues that human rights can command universal assent only if they are designed to protect and enhance the capacity of individuals to lead the lives they wish. By embracing this approach and recognizing that state sovereignty is the best guarantee against chaos, Ignatieff concludes, Western nations will have a better chance of extending the real progress of the past fifty years. The Ambivalence of Good examines the genesis and evolution of international human rights politics since the 1940s. Focusing on key developments such as the shaping of the UN human rights system, decolonization, the rise of Amnesty International, the campaigns against the Pinochet dictatorship, the moral politics of Western governments, or dissidence in Eastern Europe, the book traces how human rights profoundly, if subtly, transformed global affairs. Moving beyond monocausal explanations and narratives prioritizing one particular decade, such as the 1940s or the 1970s, The Ambivalence of Good argues that we need a complex and nuanced interpretation if we want to understand the truly global reach of human rights, and account for the hopes, conflicts, and interventions to which this idea gave rise. Thus, it portrays the story of human rights as polycentric, demonstrating how actors in various locales imbued them with widely different meanings, arguing that the political field evolved in a fitful and discontinuous process. This process was shaped by consequential shifts that emerged from the search for a new world order during the Second World War, decolonization, the desire to introduce a new political morality into world affairs during the 1970s, and the visions of a peaceful international order after the end of the Cold War. Finally, the book stresses that the projects pursued in the name of human rights nonetheless proved highly ambivalent. Self-interest was as strong a driving force as was the desire to help people in need, and while international campaigns often improved the fate of the persecuted, they were equally likely to have counterproductive effects. The Ambivalence of Good provides the first research-based synopsis of the topic and one of the first synthetic studies of a transnational political field (such as population, health, or the environment) during the twentieth century. Based on archival research in six countries, it breaks new empirical ground concerning the history of human rights in the United Nations, of human rights NGOs, of far-flung mobilizations, and of the uses of human rights in state foreign policy.
