Studienarbeit aus dem Jahr 2010 im Fachbereich Politik - Thema: Europäische Union, Europa-Universität Viadrina Frankfurt (Oder), Veranstaltung: Integrationsverantwortung in der Praxis, Sprache: Deutsch, Abstract: Der Vertag von Lissabon ist am 01. Dezember 2009 in Kraft getreten. Er war das Ergebnis eines langen Prozesses, einer Reflexionsphase, in welchem der ursprünglich geplante Vertrag über eine Verfassung für Europa (Verfassungsvertrag) vom 29. Oktober 2004 scheiterte, da unter anderem Frankreich und die Niederlande den Vertrag in Referenden ablehnten. Der Vertrag von Lissabon begreift sich nun als die Änderung des Unionsvertrages und des EG-Vertrages, welcher in den „Vertrag über die Arbeitsweise der Europäischen Union“ umbenannt wurde. Doch auch bevor der Vertrag von Lissabon vom 13. Dezember 2007 in Kraft treten konnte, galt es einige Hürden zu bewältigen. Das Bundesverfassungsgericht (BVerfG) hatte nach eingegangenen Klagen die Aufgabe, diese zu prüfen und ein Urteil über das Inkrafttreten des Vertrags von Lissabon zu fällen. Am 30. Juni 2009 war es soweit. Das Urteil des BVerfG zum Vertrag von Lissabon wurde veröffentlicht. Das Ergebnis war ein „Ja“ zum Reformvertrag, jedoch mit Einschränkungen. In der folgenden Arbeit soll eine Rezeption der Literatur über das Urteil vorgenommen werden. Dabei werden neun Zeitschriftenaufsätze untersucht, welche sich mit dem Urteil auseinandersetzen. Diese stammen aus der „Juristen Zeitung“, der Zeitschrift „Neue Juristische Wochenschrift“, der „Zeitschrift für öffentliches Recht und Verwaltungswissenschaft“, der „Stiftung Wissenschaft und Politik“, der Zeitschrift „Deutsches Verwaltungsblatt“ und dem Journal „integration“. Da aufgrund des angesetzten Umfangs dieser Arbeit nicht auf alle Aspekte zur Beurteilung des Urteil eingegangen werden kann, beschränkt sich die Rezeptur besonders auf zwei Aspekte: der erste Aspekt bezieht sich das Demokratiedefizit und dem selbst gefordertem Recht zur Überprüfung weiterer europäischer Integration. Der zweite Aspekt behandelt die Kompetenzübertragung von nationalen Kompetenzen auf EU-Ebene und dessen Überprüfung durch deutsche Organe. Beide Aspekte sind jedoch nicht ganz klar voneinander zu trennen, sondern auch immer wieder ineinander verwoben. In Unterkapiteln werden auch kurze Gesamtresümees der Autoren der Aufsätze gegeben. Der letzte Punkt im Hauptteil dieser Arbeit fasst kurz die neue Gesetzgebung zusammen, welche die Bundesregierung nach dem Urteil erlassen hat um den Forderungen des BVerfG (zumindest teilweise) gerecht zu werden.

The ever increasing relevance of European law which involves replacement or supplementation of and interaction with national law not only affects the states in Europe but also, and foremost, the citizens. The rights of the citizens in Europe are protected by the European Fundamental Rights and Freedoms. The aim of this textbook is to grasp and illustrate the meaning of these rights and to integrate it into a coherent system. For this purpose the book not only deals with the pertinent law of the European Union and the European Community, but also with the European Convention for the Protection of Human Rights and Fundamental Freedoms which, too, is becoming more and more important. In addition, regard is had to the Charter of Fundamental Rights of the Union which forms part of the Treaty establishing a Constitution for Europe. Although the Charter is not yet legally binding since the Constitution has not been ratified by all EU Member States, the Community Courts already make reference to it as a concentrate of the constitutional traditions common to the Member States. It therefore does not seem entirely unlikely that the Charter might be included into the existing Treaties irrespective of the future constitutional developments on the EU level. On a similar anticipatory basis the book also takes into account those Protocols to the European Convention for the Protection of Human Rights and Fundamental Freedoms that have not yet entered into force.
