The Council of Europe, the oldest European organisation, was founded in 1949 with the aim of unifying the continent as a whole. The decision to establish its headquarters in Strasbourg was, moreover, symbolic of the desire for reconciliation between peoples. From the outset the Council of Europe adopted an institutional structure comprising a committee of ministers and a parliamentary assembly - the first in Europe. This book retraces the history of the Organisation. When war broke out between France and Prussia in the summer of 1870, one of the first targets of the invading German armies was Strasbourg. From August 15 to September 27, Prussian forces bombarded this border city, killing hundreds of citizens, wounding thousands more, and destroying many historic buildings and landmarks. For six terror-filled weeks, "the city at the crossroads" became the epicenter of a new kind of warfare whose indiscriminate violence shocked contemporaries and led to debates over the wartime protection of civilians. The Siege of Strasbourg recovers the forgotten history of this crisis and the experiences of civilians who survived it. Rachel Chrastil shows that many of the defining features of "total war," usually thought to be a twentieth-century phenomenon, characterized the siege. Deploying a modern tactic that traumatized city-dwellers, the Germans purposefully shelled nonmilitary targets. But an unintended consequence was that outsiders were prompted to act. Intervention by the Swiss on behalf of Strasbourg's beleaguered citizens was a transformative moment: the first example of wartime international humanitarian aid intended for civilians. Weaving firsthand accounts of suffering and resilience through her narrative, Chrastil examines the myriad ethical questions surrounding what is "legal" in war and what rights civilians trapped in a war zone possess. The implications of the siege of Strasbourg far exceed their local context, to inform the dilemmas that haunt our own age--in which collateral damage and humanitarian intervention have become a crucial part of our strategic vocabulary.

Modern family life exhibits a huge variety of new forms. Legal responses to these new forms illustrate the continuing differences between European nations. Nonetheless, the Strasbourg Court has been increasingly active in this area, which provides fertile ground for testing the legitimacy of the Court's interpretation of the European Convention on Human Rights. When national law refuses to recognize a claimed right, litigants regularly reassert that right before the Strasbourg Court. This has forced it to seek answers to complex domestic controversies, such as the legal recognition for same-sex partners and transgender persons, the ethics of adoption and reproductive rights, the legal regime for cohabitants, or the accommodation of immigrants' aspiration to family reunion. Placing family rights at the core of the judicial legitimacy debate, this book provides a critical analysis of the standards of family rights protection under the Convention. It evaluates the Court's interpretive methodology and discusses the tensions inherent in its supranational quasi-constitutional function. These include the risk of excessive deference to national authorities, at the expense of the effective enforcement of universal rights; the addition of 'new rights'; and inattention to the division of responsibilities between democratic processes within sovereign States and the subsidiary international review.

Requirements for the defendant to actively participate in the English criminal process have been increasing in recent years such that the defendant can now be penalised for their non-cooperation. This book explores the changes to the defendant’s role as a participant in the criminal process and the ramifications of penalising a defendant’s non-cooperation, particularly its effect on the adversarial system. The book develops a normative theory which proposes that the criminal process should operate as a mechanism for calling the state to account for its accusations and request for official condemnation and punishment of the accused. It goes on to examine the limitations placed on the privilege against self-incrimination, the curtailment of the right to silence, and the defendant’s duty to disclose the details of his or her case prior to trial. The book shows that, by placing participatory requirements on defendants and penalising them for their non-cooperation, a system of obligatory participation has developed. This development is the consequence of pursuing efficient fact-finding with little regard for principles of fairness or the rights of the defendant.
