Decrypting Power aims to reach a unifying concept that allows the connection of the fundamental theses stemming from critical legal studies, Subaltern studies, decolonization, law and society, global political economy, critical geopolitics and theories of de-coloniality. This volume proposes that this concept is the ‘encryption of power’, a category of analysis that reveals the weakness of political liberalism when it takes the place of the legitimate fundament of democracy, as well as its consummate capacity to conceal new mechanisms of global power. The theory of encryption of power understands that there is only a world where difference exists as the fundamental and sole order, but also that such a possibility is heavily obstructed by the concentration of power in forms of oppression. The world hangs on the thread of this entangled reality, made up of difference and its denial, of democracy and its simulations, of truth and its codifications. The decryption of power is then, above all, a theory of justice essential to radical democracy, which comes fully-equipped to prevail over the conditions that deny the possibility of an egalitarian world.

This book deploys the theory of encryption of to decrypt justice, setting in opposition Justice, written with the hegemonic capital letters of Western ideas, and justice, in its everyday workings within disparate communal forms and the exercise of multiplicity. As it decrypts justice, the book argues that late-coloniality, through its construction of the “hidden people,” shattered the possibility of true communities in the service of a transcendent model, consisting ofthe market, the constitution, the nation, and the economy. The first three chapters serve as the theoretical backbone of the book, engaging sovereignty, posthumanism, Artificial Intelligence, and epistemic injustice. Chapters 4 and 5 describe the emancipation of the people through alternate communal practices: “Quilombismo” in Brazil and “Corazonar” of Tseltal women in Mexico. Chapter 7 examines the Tosepan’s practices in Mexico to decrypt hegemonic territorial forms, and chapters 6 and 8 explore how Western judicial systems disempower the people, focusing on Central American migrants and critiques from the Colombian peace process. This open access book simultaneously addresses both the segmenting and the egalitarian function of individual labour law, in almost all countries of the world, in some chapters following up from its origin to the present. Its socio-legal approach fills gaps for sociological, legal and historical research of regulatory social policy. Labour law is dealt with both in qualitative (theoretical, hermeneutic and historical) and in quantitative manner (with the leximetrics method developing new ways to measure generosity and coverage of law). This is a groundbreaking contribution to regulatory social policy research. By indicating the relevance and the mechanisms of legal segmentation for labour market segmentation, unequal opportunities and social stratification it provides evidence for the assumptions that social segmentation does not only stem from market forces, but also from the law itself. This book examines the implications of information security which plays such an important role in modern digital infrastructure. Information security technologies restrict the (mis)use of this infrastructure, while also constantly being probed by researchers, intelligence agencies and criminals. One can see this cycle of making and breaking everywhere in the digital sphere. An important example of this cat-and-mouse game is the development of quantum computers, which may in the near future break some widely used encryption technologies. This cycle also has implications for human rights: weakening encryption may affect privacy, for example. But the relationship between human rights and information security has not been investigated in-depth before. In this study, state obligations relating to information security are analysed under the European Convention for Human Rights and the EU Charter for Fundamental Rights, focusing on issues as human rights-compatible encryption policy, on how governments should deal with vulnerabilities in software, and whether governments can curtail the development and export of quantum computers. This book analyses the human rights-compatibility of quantum computing governance and offers unique insights into the connection between human rights and information security that will be relevant for legal practitioners, policy-makers and academics involved in this field of research.
