European Convention on Human Rights – Article 10 – Freedom of expression 1. Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. This article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises. 2. The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary. In the context of an effective democracy and respect for human rights mentioned in the Preamble to the European Convention on Human Rights, freedom of expression is not only important in its own right, but it also plays a central part in the protection of other rights under the Convention. Without a broad guarantee of the right to freedom of expression protected by independent and impartial courts, there is no free country, there is no democracy. This general proposition is undeniable. This handbook is a practical tool for legal professionals from Council of Europe member states who wish to strengthen their skills in applying the European Convention on Human Rights and the case law of the European Court of Human Rights in their daily work.

On the eve of the invasion of Iraq, President G.W. Bush argued that if setting up democracy in Japan and Germany after WW II was successful, then it should also be successful in Iraq. This book provides a detailed comparison of the reconstruction of Japan from 1945 to 1952 with the current reconstruction of Iraq, evaluating the key factors affecting the success or failure of such projects. The book seeks to understand why American officials believed that extensive social reengineering aiming at seeding democracy and economic development is replicable, through identifying factors explaining the outcome of U.S.-led post-conflict reconstruction projects. The analysis reveals that in addition to the effective use of material resources of power, the outcome of reconstruction projects depends on a variety of other intertwined factors, and Bridoux provides a new analytical framework relying on a Gramscian concept of power to develop a greater understanding of these factors, and the ultimate success or failure of these reconstruction projects. Appraising the effectiveness of American power in the contemporary international structure, this work is a significant contribution to the field and will be of great interest to all scholars of foreign policy, international relations and conflict studies.

This book uses a comparative case study approach to examine how security cultures change under the impact of political shocks and learning through failure. The book thus analyzes the security cultures of Germany and the United States as they evolve under the impact of the war in Bosnia-Herzegovina from 1992 to 1995. The thesis thereby also enhances our understanding of German and U.S. foreign policies. Using paired observations for controlled comparison, the thesis employs process tracing to examine the nature and quantity of change. The case studies demonstrate that security cultures influence the assessment of political situations, restrain policy objectives, and condition the range of issues to which political attention is devoted. Both cases reveal that security cultures affect the evaluation of policy options and the choices that are made. The thesis argues that different transformations of German and U.S. security cultures led to divergent political behavior particularly with regard to the use of force, resulting in more forceful and effective interventions in Bosnia and a reframing of future interventions in third-party conflicts. Domestic reactions to the Bosnian war transformed the security culture in Germany, whereas reactions in the U.S. triggered a re-ranking of cultural preferences. Understanding how security cultures change and evolve through exogenous and endogenous factors improves the chances of policy success in today's challenging international environment.

If boundaries protect us from threats, how should we think about the boundaries of states in a world where threats to human rights emanate from both outside the state and the state itself? Arguing that attitudes towards boundaries are premised on assumptions about the locus of threats to vital interests, Rahul Rao digs beneath two major normative orientations towards boundaries-cosmopolitanism and nationalism-which structure thinking on questions of public policy and identity. Insofar as the Third World is concerned, hegemonic versions of both orientations are underpinned by simplistic imageries of threat. In the cosmopolitan gaze, political and economic crises in the Third World are attributed mainly to factors internal to the Third World state with the international playing the role of heroic saviour. In Third World nationalist imagery, the international is portrayed as a realm of neo-imperialist predation from which the domestic has to be secured. Both images capture widely held intuitions about the sources of threats to human rights, but each by itself provides a resolutely partial inventory of these threats. By juxtaposing critical accounts of both discourses, Rao argues that protest sensibilities in the current conjuncture must be critical of hegemonic variants of both cosmopolitanism and nationalism. The second half of the book illustrates what such a critique might look like. Journeying through the writings of James Joyce, Rabindranath Tagore, Edward Said and Frantz Fanon, the activism of 'anti-globalisation' protesters, and the dilemmas of queer rights activists, Rao demonstrates that important currents of Third World protest have long battled against both the international and the domestic, in a manner that combines nationalist and cosmopolitan sensibilities.

In the wake of the monstrous projects of Hitler, Stalin, Mao, and others in the twentieth century, the idea of utopia has been discredited. Yet, historian Jay Winter suggests, alongside the ?major utopians” who murdered millions in their attempts to transform the world were disparate groups of people trying in their own separate ways to imagine a radically better world. This original book focuses on some of the twentieth-century's ?minor utopias” whose stories, overshadowed by the horrors of the Holocaust and the Gulag, suggest that the future need not be as catastrophic as the past. The book is organized around six key moments when utopian ideas and projects flourished in Europe: 1900 (the Paris World's Fair), 1919 (the Paris Peace Conference), 1937 (the Paris exhibition celebrating science and light), 1948 (the Universal Declaration of Human Rights), 1968 (moral indictments and student revolt), and 1992 (the emergence of visions of global citizenship). Winter considers the dreamers and the nature of their dreams as well as their connections to one another and to the history of utopian thought. By restoring minor utopias to their rightful place in the recent past, Winter fills an important gap in the history of social thought and action in the twentieth century.
