This book traces the history of the Dār al-Iftā, the Egyptian State Mufti's administration, from its inception in the 1890s to the present. Often uncomfortably positioned between a state bureaucracy and an emerging Muslim public concerned with the transmission of Islamic values, the various State Muftis have been striving to reinterpret Islamic law and demonstrate its relevance in the modern age. The history of the Dār al-Iftā thus provides a rare insight into major themes of 20th-century Islamic thinking. Four case studies demonstrate how fatwas can be used as sources for legal, social, intellectual and mentality history. Defining Islam for the Egyptian State will be of great interest to students of Islamic law and social and intellectual history of the modern Middle East.

My first guiding thesis is that there is a cleavage between state and society in Egypt and I want to show some aspects and dimensions of its present status and its historical origins. The two central fields of my study will be firstly the actual secular state practice and its ideological origins and secondly Islam, its influence in Egyptian society, and its compatibility to liberal trends, the concept of civil society or democracy in general. To look at public participation in any state is an ambitious task, for the field of participation is broad and hard to measure. I will deal with political public participation. Public participation can be limited to social groups, like syndicates. By aims I am referring to the fact that different groups have different participatory intentions. This aspect becomes more interesting when looking at Islamist groups. Looking at public participation is at the same time looking at democratic processes and political culture of the society being analysed. This includes regarding in what way the preconditions for political participation are provided: Freedom of opinion and expression, freedom of assembly, freedom of press and last but not least education. Political culture includes as well many cultural aspects of the society analysed, here Islam comes in as a religion as well as a theoretical system for a society respectively a state. The Kharijites were the first sectarian movement in Islamic history, a rebellious splinter group that separated itself from mainstream Muslim society and set about creating, through violence, an ideal community of the saved. Their influence in the political and theological life of the nascent faith has ensured their place in both critical and religious accounts of early Islamic history. Based on the image of sect fostered by the Islamic tradition, the name Kharijite defines a Muslim as an overly-pious zealot whose ideas and actions lie beyond the pale of normative Islam. After a brief look at Kharijite origins and the traditional image of these early rebels, this book focuses on references to the Kharijites in Egypt from the 1950s to the 1990s. Jeffrey T. Kenney shows how the traditional image of the Kharijites was reawakened to address the problem of radical Islamist opposition movements. The Kharijites came to play a central role in the rhetoric of both religious authorities, whose official role it is to interpret Islam for the masses, and the secular state, which cynically turns to Islamic ideas and symbols to defend its legitimacy. Even those Islamists who defend militant tactics, and who are themselves tainted by the Kharijite label, become participants in the discourse surrounding Kharijism. Although all Egyptians agree that modern Kharijites represent a dangerous threat to society, serious debates have arisen about the underlying social, political and economic problems that lead Muslims down this destructive path. Kenney examines these debates and what they reveal about Egyptian attitudes toward Islamist violence and its impact on their nation. Long before 9/11, Egyptians have been dealing with the problem of Islamist violence, frequently evoking the Kharijites. This book represents an important contribution to Islamic studies and Middle East studies, adding to our understanding of how the Islamic past shapes the present discourse surrounding Islamist violence in one Muslim society.

In "The Politics of Islamic Law" political scientist Iza Hussin offers a genealogy of contemporary Islamic law, a political analysis of elite negotiations over religion, state, and society in the British colonial period, and a history of current Muslim approaches to law, state, and identity. Hussin argues that Islamic law as it is legislated and debated throughout the Muslim world today is no longer the "shari ah" as it previously existed. She shows that shari ah an uncodified and locally administered set of legal institutions and laws with wide-ranging jurisdiction was transformed (not eradicated as some have argued) during the British colonial period into a codified, state-centered system with jurisdiction largely limited to law regarding family, personal status, ethnic identity, and the private domain. As a result, the practices, beliefs, and possibilities inherent in law, changed, and so did the strategies, attitudes and aspirations of those who used this changing system. Its present institutional forms, its substantive content, its symbolic vocabulary, and its relationship to state and society in short, its politics are built upon foundations laid during the colonial encounter, in struggles between local and colonial elites. "The Politics of Islamic Law" undertakes a cross-regional comparison of India, Malaya, and Egypt which illustrates that Islamic law is a trans-global product shaped by local political networks. The rearrangement of the local elite combined with the new reach of the state made possible by colonial power gave local elites a vested interest in this twinning of the centrality of Islamic legitimacy and the marginalization of its legal content. These processes are traced through close examinations of debates over jurisdiction, the definition of Islamic law, and in turn the nature of the state. This work makes an important contribution to critical debates in comparative politics, history, legal anthropology, comparative law, and Islamic studies."

By examining the intersection of Islamic law, state law, religion, and culture in the Egyptian nation-building process, Recasting Islamic Law highlights how the sharia, when attached to constitutional commitments, is reshaped into modern Islamic state law. Rachel M. Scott analyzes the complex effects of constitutional commitments to the sharia in the wake of the Egyptian Revolution of 2011. She argues that the sharia is not dismantled by the modern state when it is applied as modern Islamic state law, but rather recast in its service. In showing the particular forms that the sharia takes when it is applied as modern Islamic state law, Scott pushes back against assumptions that introductions of the sharia into modern state law result in either the revival of medieval Islam or in its complete transformation. Scott engages with premodern law and with the Ottoman legal legacy on topics concerning Egypt's Coptic community, women's rights, personal status law, and the relationship between religious scholars and the Supreme Constitutional Court. Recasting Islamic Law considers modern Islamic state law's discontinuities and its continuities with premodern sharia.
