How many citizens take part in moral and political decisions concerning the results obtained by the contemporary life sciences? Should they blindly follow skilled demagogues or false and deceptive leaders? Should they adhere to the voice of the majority, or should they take a different decisional path? Deliberative democracy answers these questions, but what is deliberative democracy? Can we really deliberate if we are completely ignorant of the relevant issue? What about ethical or political expertise, is it strictly necessary? Finally, and most significantly, can a deliberative process take place if we ignore the techniques governing it; that is, the techniques required to be minimally skilled in rational argumentation? Giovanni Boniolo goes back to the historical and theoretical foundations of deliberation showing us, with some irony, that deliberation is a matter of competence, and not just a matter of a right to decide. His conclusion might not delight everyone: “anyone who is not sufficiently acquainted with the subject matter or lacks the sufficient deliberative competence ought not be admitted to deliberative discussions. This restriction makes both good deliberation and a proper deliberative democracy possible, otherwise debate degenerates into demagogy and hypocrisy”.

This essay explores how application of deliberative democracy and conflict resolution theories expose how the town hall meetings conducted on debates about recent American healthcare reform were poorly managed. The article suggests that for truly deliberative democracy to work, theory and practice must take account of three forms of discourse: rational-principled, bargaining-trading (utilitarian) and affective, emotional and value-based discourses. The article explores deliberative democracy and conflict resolution theory (e.g., Habermas, Hampshire), contrasts these to more nuanced analyses of what is possible in political deliberation processes (Elster, Sen, and Fishkin, among others) and describes how the town hall meetings were poorly executed in practice. Suggestions are offered for both theoretical issues (how are professional process experts, e.g. facilitators of consensus building fora to be justified in democratic theory) and practical variations on process themes, in the hopes that well structured and variable processes might still be designed and utilized for facilitating productive participation in the polity and more "consensus-seeking," and better and more flexible policy outcomes, even in highly contested political issues.

The twenty-first century is characterized by the global circulation of cultures, norms, representations, discourses, and human rights claims; the arising conflicts require innovative understandings of decision making. Deliberative Acts develops a new, cogent theory of performative deliberation. Rather than conceiving deliberation within the familiar frameworks of persuasion, identification, or procedural democracy, it privileges speech acts and bodily enactments that constitute deliberation itself, reorienting deliberative theory toward the initiating moment of recognition, a moment in which interlocutors are positioned in relationship to each other and so may begin to construct a new lifeworld. By approaching human rights not as norms or laws, but as deliberative acts, Lyon conceives rights as relationships among people and as ongoing political and historical projects developing communal norms through global and cross-cultural interactions.

The dissertation explored how deliberative activity is constructed within ongoing social conflict. The study examined mediator actions for keeping the disputants on task -- that is, on negotiating plans about caring for their children. This focus enabled an empirical investigation of three interrelated theoretical interests: (1) how an institutionally preferred form of interactivity is constructed in the ongoing course of interaction, (2) the role of the mediator as an ostensible designer of communication activity, and (3) the relationship between interaction and reasoning. An existing collection of 18 transcripts from audio recordings of mediation sessions at a mediation center in the western United States served as a source of interactional data. The participants of mediation sessions were eight mediators and 17 divorcing or divorced couples. The main focus of observation was on mediator communicative practices for keeping disputants on task. These were observed by attending to the word choices of mediators and their language actions evident across a corpus of transcripts. As the dialogue quality is a mutual achievement of all the participants, not just the mediator, the center of attention was also on different linguistic and interactional resources disputants provide in the course of interaction. The simple categories were useful for getting at higher order concepts such as topics and dialogue activities. There were four main findings from the empirical study. First, an institutionally preferred form of interactivity is constructed ongoing, often implicit, negotiation of what is on or off task through the uses of linguistic and interactional "materials" available in the moment to the participants. Second, mediators' uses of language to make references, establish topics, and launch dialogue activities are design moves that signal what is on-task and thus articulate the deliberative activity. Third, mediators construct their interventions in such a way as to balance concerns for face and the institutional goal for interaction. Fourth, argument and reasoning are constituted through interaction that imposes various constraints on what contributions are appropriate in mediation talk.

China’s territorial disputes have been a matter of debate since the 1950s. While China has amicably resolved boundary disputes with 12 out of 14 neighbouring countries, it is yet to resolve its boundary disputes with India and Bhutan as also its two martime disputes in the South China Sea and East China Sea. Given that the prediction for the settlement of China’s remaining disputes is largely doubtful, this book investigates the reasons for differences in Chinese behaviour with India. China’s boundary dispute with India is a subject of deliberation and it remains to be seen whether China plans to devise its ‘boundary diplomacy’ with a country as huge and strong as India.
