The twenty-first century is characterized by the global circulation of cultures, norms, representations, discourses, and human rights claims; the arising conflicts require innovative understandings of decision making. Deliberative Acts develops a new, cogent theory of performative deliberation. Rather than conceiving deliberation within the familiar frameworks of persuasion, identification, or procedural democracy, it privileges speech acts and bodily enactments that constitute deliberation itself, reorienting deliberative theory toward the initiating moment of recognition, a moment in which interlocutors are positioned in relationship to each other and so may begin to construct a new lifeworld. By approaching human rights not as norms or laws, but as deliberative acts, Lyon conceives rights as relationships among people and as ongoing political and historical projects developing communal norms through global and cross-cultural interactions.

Deliberative democracy has challenged two widely-accepted nostrums about democratic politics: that people lack the capacities for effective self-government; and that democratic procedures are arbitrary and do not reflect popular will; indeed, that the idea of popular will is itself illusory. On the contrary, deliberative democrats have shown that people are capable of being sophisticated, creative problem solvers, given the right opportunities in the right kinds of democratic institutions. But deliberative empirical research has its own problems. In this book two leading deliberative scholars review decades of that research and reveal three important issues. First, the concept 'deliberation' has been inflated so much as to lose empirical bite; second, deliberation has been equated with entire processes of which it is just one feature; and third, such processes are confused with democracy in a deliberative mode more generally. In other words, studies frequently apply micro-level tools and concepts to make macro- and meso-level judgements, and vice versa. Instead, Bächtiger and Parkinson argue that deliberation must be understood as contingent, performative, and distributed. They argue that deliberation needs to be disentangled from other communicative modes; that appropriate tools need to be deployed at the right level of analysis; and that scholars need to be clear about whether they are making additive judgements or summative ones. They then apply that understanding to set out a new agenda and new empirical tools for deliberative empirical scholarship at the micro, meso, and macro levels.

Freedom of speech is a basic right in a democracy. During war, however, national legislatures tend to enact laws that restrict this basic right. Under what circumstances can such laws be democratically legitimate? Avichai Levit argues that the degree of democratic legitimacy of laws that restrict freedom of speech during war depends on the extent of legislature deliberation on such laws. The more law makers in both chambers of the legislature seriously consider information and arguments, reason on the common good and seek to persuade and decide the best legislative outcome, in committees and on the floor, the more democratic legitimacy can be associated with such laws. This book fills a gap in the scholarly literature regarding the evaluation of the democratic legitimacy of laws that restrict freedom of speech during war, by bridging different theoretical perceptions and presenting an alternative normative account of deliberative democracy which focuses on the deliberations of a national legislature. Using the United States as a case study, Levit delves into the details of Congressional deliberation during World War I, World War II and the Cold War, as well as the political histories that brought about such laws. Political theorists often see deliberation--understood as communication and debate among citizens--as a fundamental act of democratic citizenship. In other words, the legitimacy of a decision is not simply a function of the number of votes received, but the quality of the deliberation that precedes voting. Efforts to enhance the quality of deliberation have focused on designing more inclusive deliberative procedures or encouraging citizens to be more internally reflective or empathetic. But the adequacy of such efforts remains questionable. Beyond Empathy and Inclusion aims to better understand the prospects of democracy in a world where citizens are often uninterested or unwilling to engage across social distance and disagreement. Specifically, the book considers how our practices of listening affect the quality and democratic potential of deliberation. Mary F. Scudder offers a systematic theory of listening acts to explain the democratic force of listening. Modeled after speech act theory, Scudder's listening act theory shows how we do something in the act of listening, independent of the outcomes of this act. In listening to our fellow citizens, we recognize their moral equality of voice. Being heard by our fellow citizens is what ensures we have a say in the laws to which we are held. The book also tackles timely questions regarding the limits of toleration and listening in a democratic society. Do we owe listening even to democracy's enemies? After all, a virtue of democratic citizenship is the ability to resist political movements that seek to destroy democracy. Despite these challenges and risks, Scudder shows that listening is a key responsibility of democratic citizenship, and examines how listening can be used defensively to protect against threats to democracy. While listening is admittedly difficult, especially in pluralist societies, this book investigates how to motivate citizens to listen seriously, attentively, and humbly, even to those with whom they disagree.

Laws have colonised most of the corners of political practice, and now substantially determine the process and even the product of democracy. Yet analysis of these laws of politics has been hobbled by a limited set of theories about politics. Largely absent is the perspective of deliberative democracy – a rising theme in political studies that seeks a more rational, cooperative, informed, and truly democratic politics. Legal and political scholarship often view each other in reductive terms. This book breaks through such caricatures to provide the first full-length examination of whether and how the law of politics can match deliberative democratic ideals. Essential reading for those interested in either law or politics, the book presents a challenging critique of laws governing electoral politics in the English-speaking world. Judges often act as spoilers, vetoing or naively reshaping schemes meant to enhance deliberation. This pattern testifies to deliberation’s weak penetration into legal consciousness. It is also a fault of deliberative democracy scholarship itself, which says little about how deliberation connects with the actual practice of law. Superficially, the law of politics and deliberative democracy appear starkly incompatible. Yet, after laying out this critique, The Law of Deliberative Democracy considers prospects for reform. The book contends that the conflict between law and public deliberation is not inevitable: it results from judicial and legislative choices. Deliberative democracy is an embattled political project. It is accused of political naiveté for it only talks about power without taking power. Others, meanwhile, take issue with deliberative democracy’s dominance in the field of democratic theory and practice.
