We consider the case where a species provides a flow of economic benefits, is at risk of extinction, and is being considered for addition to the Endangered Species List. Listing a species as endangered is costly but increases the flow of social benefits and reduces the likelihood of extinction. If the species recovers sufficiently, additional costs can be incurred to subsequently delist the species. By treating listing and delisting as a pair of linked investment options, we provide an alternative to current practice for listing and delisting decisions that maximizes the return from public conservation investments. Under this alternative framework, we show that economic considerations may actually afford greater protection for at-risk species if these decisions are initiated early. However, biological sources of uncertainty may cause those species most in need of protection to be passed over in favor of more stable species that represent a “sure bet” for species preservation.

The Law Library presents the complete text of the Endangered and Threatened Species - Delisting of the Eastern Distinct Population Segment of Steller Sea Lion under the Endangered Species Act (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 Under the authority of the Endangered Species Act of 1973, as amended (ESA), we, NMFS, issue this final rule to remove the eastern distinct population segment (DPS) of Steller sea lion (Eumetopias jubatus) from the List of Endangered and Threatened Wildlife. After receiving two petitions to delist this DPS, we completed a review of the status of the eastern DPS of Steller Sea Lion. Based on the information presented in the Status Review, the factors for delisting in section 4(a)(1) of the ESA, the recovery criteria in the 2008 Recovery Plan, the continuing efforts to protect the species, and information received during public comment and peer review, we have determined that this DPS has recovered and no longer meets the definition of an endangered or threatened species under the ESA: It is not in danger of extinction or likely to become so within the foreseeable future throughout all or a significant portion of its range. Thus, we find that the delisting of the DPS is warranted. This rule also makes technical changes that recodify existing regulatory provisions to remove special protections for the eastern DPS and clarify that existing regulatory protections for the western DPS of Steller sea lions continue to apply. The recovery and delisting of species protected under the Endangered Species Act is the coming fashion and no mistake. This spring many of us followed with interest the nesting trevails of California condors in California and Arizona as the birds endeavored to lay the foundations for a comeback. At the same time, we watched with mixed feelings building pressure to delist gray wolves and the announced delisting of the Aleutian Canada geese. The United States Fish and Wildlife Service has committed itself to recovery as the goal for its species protection program. Unfortunately, under the provisions of the law and the logic of politics there is great pressure to measure the success of recovery efforts in terms of species delisting. Recovery may have the power to transform the popular image of the Endangered Species Act from a statute about stopping development into a statute about preserving species. However, only delisting can, in theory, decouple protection of biodiversity from the much maligned business of getting government permits and dealings with federal officials. Like it or not, the common notions of recovery and delisting - bringing species to the point at which they are so numerous and so well distributed in sufficient quantities of perpetually secure habitat that the protections provided by the Endangered Species Act become unnecessary - will not become a realistic aspiration for any significant number of species any time in the foreseeable future. Yet there is political pressure to quot;show resultsquot; by declaring species recovered and removing them from the lists of protected species. Can the federal government emphasize species recovery and delisting in the face of collapsing global ecosystems? The answer, of course, is yes. The real question is how.
