As people become more mobile around the world, the nature of citizenship, and all its attendant rights, has become the object of intense scrutiny. And, as we know, democracies forcefully and coercively exclude those whom they believe do not belong on their territory or among their constituency. In Democracy and Exclusion, Patti Tamara Lenard looks at how and when democracies exclude both citizens and noncitizens from territory and from membership to determine if and when there are instances when such exclusion is justified. To make her case, Lenard draws on the all-subjected principle, or the idea that all those who are the subject of law--that is, those who are required to abide by the law and who are subject to coercion if they do not do so voluntarily--should have a say in what the law is. If we assess who is subjected to the power of a state at any particular moment, and especially over time, we can see who ought to be treated as a member and therefore be granted citizenship or the right to stay. With an in-depth look at instances in which democratic states have expanded or adopted policies that permit the exclusion of citizens--including denationalization, stateless peoples, labor migrants, returning foreign fighters, and LGBTQ+ refugee resettlement--Lenard argues that admission to territory and membership is either favored by, or required by, democratic justice. Democracy and Exclusion makes a powerful case that subjection to the power of a state, without proper protection from exclusion, is a violation of democratic principle.

Social exclusion and inclusion remain issues of fundamental importance to democracy. Both exclusion and inclusion relate to the access to participation in the public realm, public goods and services for certain groups of people who are minorities, marginalized and deprived. Democratization has led to the inclusion of the previously excluded in the political process. While the problems of exclusion remain even in advanced Western countries in respect of the minorities of sorts, and the underprivileged, the problem of deep-rooted social and cultural exclusions is acute in post-colonial countries, including India. The denial of voting rights to certain types of persons continues to be a moral problem of practical significance. The disenfranchisement of persons with mental impairments, minors, noncitizen residents, nonresident citizens, and criminal offenders is a matter of controversy in many countries. How should we think morally about electoral exclusions? What should we conclude about these particular cases? This book proposes a set of principles, called the Critical Suffrage Doctrine, that defies conventional beliefs on the legitimate denial of the franchise. According to the Critical Suffrage Doctrine, in some realistic circumstances it is morally acceptable to adopt an alternative to universal suffrage that would exclude the vast majority of sane adults for being largely uninformed. Thus, contrary to what most people believe, current controversies on the franchise are not about exploring the limits of a basic moral right. Regarding such controversies, the Critical Suffrage Doctrine establishes that, in polities with universal suffrage, the blanket disenfranchisement of minors and the mentally impaired cannot be justified; that noncitizen residents should be allowed to vote; that excluding nonresident citizens is permissible; and that criminal offenders should not be disenfranchised-although facilitating voting from prison is not required in all contexts. Political theorists have rarely submitted the franchise to serious scrutiny. Hence this study makes a contribution to a largely neglected and important subject.
