Democracy, Law and Governance details the transformation of the modes of governance of contemporary developed democracies and aims to define the conditions required for promoting public interest in their public policy. Firstly, the volume illustrates why a sound theoretical approach to the concept of law results in opening up the theory of law to the debate on governance in the social sciences. Secondly, it reconstructs the underpinnings of recent debate on governance, focusing on the pragmatist turn that has marked efforts to overcome the inadequacies of both the economic and the deliberative approaches. In fulfilling this second goal, it examines the advances yielded by the pragmatist turn as well as its limitations, and concludes by proposing a theoretical approach for dealing with them. This illuminating book applies recent research in both theory of law and theory of governance to deepen the analytic impact of the recent pragmatist revival.

Law is an increasingly pervasive force in our society. At the same time, however, the obstacles to law’s effectiveness are also growing. In The limits of Law, Yale law professor Peter H, Schuck draws on law, social science, and history to explore this momentous clash between law’s compelling promise of ordered liberty and the realistic limits of its capacity to deliver on this promise. Schuck first discusses the constraints within which law must work–law’s own complexity, the cultural chasms it must bridge, and the social diversity it must accommodate–and proceeds to consider the ways law uses regulatory, legislative, and adjudicatory processes to influence social behavior. He shows how politics shapes regulation, how regulation might incorporate individualized equity, and how it can best be reformed. Turning to legislation, he justifies a strong role for special interest groups, dissects purely symbolic statutes, and defends broad delegations of legislative power to regulatory agencies. This collection studies the rise of neutral bodies as a challenge to the constitutional paradigm of the nation state. Administrative entities such as commissions, agencies, councils, authorities or ‘independent agencies’ as they are sometimes known, are relatively autonomous from majoritarian democratic control and by their institutional design fall outside the classical triad of powers or branches of government. They may even fall outside the confines of the nation state itself as with the EU Commission. The book is divided into theoretical-historical and empirical parts. Part I approaches the phenomenon through the rigorous normative conceptual lens of constitutionalism and constitutional law, questioning the implications of political neutrality on inherited normative categories, both at national and supranational level. Part II comprises case-studies reflecting the full spectrum of theoretical frameworks and concerns developed and explored by the theory-oriented chapters in the first part. Despite the large amounts of human and financial resources invested to foster democratic governance in developing countries, statistics show that the majority of these countries have not yet achieved significant improvements in living standards. While some regions make strides towards improving the living conditions of their citizens, Sub-Saharan Africa, for instance, is still trapped in poverty with more than 40% of its 600 million people living below the internationally recognized absolute poverty line of one US dollar per day. Poor governance and corruption should be highlighted as the most important systemic factors contributing to poverty in developing countries. As a result the institutional foundations of these countries are weakened, public funds are misappropriated, and policies and programs aimed at reducing poverty and fostering sustainable economic growth are undermined. It is therefore not surprising that a 2008 Transparency International report found a direct link between corruption and the failure of the societal institutions designed to achieve the Millennium Development Goals in the majority of developing countries. This book investigates the problems of democratic governance, particularly as they relate to corruption, and also whether democracy should be based on universal principles or local context and historical factors. It also analyses the rule of law, in promoting democratic governance and curbing corruption and if governmental, non-governmental organizations, and civil societies are effective in promoting democratic governance and curbing corruption. This book will go beyond identifying the challenges and offer plausible solutions that could be adapted to various developing countries. It is premised on the importance of bridging theory and practice, which has been lacking in most local and international development publications, making of interest to scholars and policy-makers alike concerned with public administration in developing countries.
