In a critical dialogue with John Rawls and Jurgen Habermas, the world's most influential political philosophers, Kuper exposes the flawed assumption that nation-states should be the only fundamental political units. He develops instead a theory of global justice that also harnesses the capabilities of non-state actors - such as corporations, non-governmental organizations, and civil society networks. An innovative conception of democracy for an era of globalization and delegation of authority beyond the nation-state: rule by peoples across borders rather than by "the people" within a fixed jurisdiction. Today democracy is both exalted as the "best means to realize human rights" and seen as weakened because of globalization and delegation of authority beyond the nation-state. In this provocative book, James Bohman argues that democracies face a period of renewal and transformation and that democracy itself needs redefinition according to a new transnational ideal. Democracy, he writes, should be rethought in the plural; it should no longer be understood as rule by the people (dêmos), singular, with a specific territorial identification and connotation, but as rule by peoples (dêmoi), across national boundaries. Bohman shows that this new conception of transnational democracy requires reexamination of such fundamental ideas as the people, the public, citizenship, human rights, and federalism, and he argues that it offers a feasible approach to realizing democracy in a globalized world. In his account, Bohman establishes the conceptual foundations of transnational democracy by examining in detail current theories of democracy beyond the nation-state (including those proposed by Rawls, Habermas, Held, and Dryzek) and offers a deliberative alternative. He considers the importance of communicative freedom in the transnational public sphere (including networked communication over the Internet), human rights as the normative basis of transnational democracy, and the European Union as a transnational polity. Finally, he examines the relationship between peace and democracy, concluding that peace requires democratization on interacting state and suprastate levels.

Spain is a notable exception to the implicit rules of late twentieth-century democratization: after the death of General Francisco Franco in 1975, the recovering nation began to consolidate democracy without enacting any of the mechanisms promoted by the international transitional justice movement. There were no political trials, no truth and reconciliation commissions, no formal attributions of blame, and no apologies. Instead, Spain's national parties negotiated the Pact of Forgetting, an agreement intended to place the bloody Spanish Civil War and the authoritarian excesses of the Franco dictatorship firmly in the past, not to be revisited even in conversation. Formalized by an amnesty law in 1977, this agreement defies the conventional wisdom that considers retribution and reconciliation vital to rebuilding a stable nation. Although not without its dark side, such as the silence imposed upon the victims of the Civil War and the dictatorship, the Pact of Forgetting allowed for the peaceful emergence of a democratic state, one with remarkable political stability and even a reputation as a trailblazer for the national rights and protections of minority groups. Omar G. Encarnación examines the factors in Spanish political history that made the Pact of Forgetting possible, tracing the challenges and consequences of sustaining the agreement until its dramatic reversal with the 2007 Law of Historical Memory. The combined forces of a collective will to avoid revisiting the traumas of a difficult and painful past and the reliance on the reformed political institutions of the old regime to anchor the democratic transition created a climate conducive to forgetting. At the same time, the political movement to forget encouraged the embrace of a new national identity as a modern and democratic European state. Demonstrating the surprising compatibility of forgetting and democracy, Democratization Without Justice in Spain offers a crucial counterexample to the transitional justice movement. The refusal to confront and redress the past did not inhibit the rise of a successful democracy in Spain; on the contrary, by leaving the past behind, Spain chose not to repeat it.

The book is coherent in its focus on a common theme and aim: to advance and refine the political project of promoting democratic theory and practice. Each builds on and expands the central theme of democracy and ultimately contends with potential limits of current configurations of democratic life. Citizens are called upon to be more than just voters but rather define themselves by participation in a community beyond their self-interest—in fact arguing, like Aristotle, Rousseau, Jefferson and Arendt, that we are only human when we participate in something beyond ourselves, that we forge and preserve our political community by our commitment to and participation in robust debate and meaningful political action.
