As of 17 December 2010, the Rome I Regulation (EU Regulation 593/2008) on the law applicable to contractual obligations is directly applicable in all EU Member States with the exception of Denmark. The Rome I Regulation replaces the Rome Convention of 1980 in the EU Member States and will apply to all contracts concluded as of 17 December 2010. However, and herein lies the utility and great importance of this work, the Rome Convention and the Rome I Regulation will be applied in parallel for a significant time to come (the author himself anticipates a ten-to-fifteen year period); in the latter case to contracts made after 17 December, 2010. This is why this commentary takes into account both sources of law, in their mutual interaction and broader context. The comprehensiveness of the Rome Convention / Rome I Regulation is clearly apparent, but one of the great achievements of the author is his amassing of over 1,800 judicial decisions, most of which are furnished with a detailed commentary; where these decisions apply national laws, the latter are cited both in the original and in translation. For a number of rulings, the commentary include not only a case summary of the facts and an analysis of the conclusions drawn by the court, but also takes them as models to hypothesize what conclusions would be reached if the Rome I Regulation were to be applied.

Since the onset of the Great Recession, Germany’s economy has been praised for its superior performance, which has been reminiscent of the "economic miracle" of the 1950s and 1960s. Such acclaim is surprising because Germany’s economic institutions were widely dismissed as faulty just a decade ago. In Holding the Shop Together, Stephen J. Silvia examines the oscillations of the German economy across the entire postwar period through one of its most important components—the industrial relations system. As Silvia shows in this wide-ranging and deeply informed account, the industrial relations system is strongest where the German economy is strongest and is responsible for many of the distinctive features of postwar German capitalism. It extends into the boardrooms, workplaces and government to a degree that is unimaginable in most other countries. Trends in German industrial relations, moreover, influence developments in the broader German economy and, frequently, industrial relations practice abroad. All these aspects make the German industrial relations regime an ideal focal point for developing a deeper understanding of the German economy as a whole. Silvia begins by presenting the framework of the German industrial relations system—labor laws and the role of the state—and then analyzes its principal actors: trade unions and employers’ associations. He finds the framework sound but the actors in crisis because of membership losses. Silvia analyzes the reasons behind the losses and the innovative strategies German labor and management have developed in their efforts to reverse them. No one denies that the institution of collective bargaining between workers and employers has been a powerful tool for social dialogue. Without our history of effective collective bargaining there would be no mutual understanding, no industrial peace, no constructive cooperation between social partners. Yet there is a feeling today that this history has drawn to a close; that our post-industrial world demands something different, something our tradition of collective bargaining and collective agreements cannot give us. What information and insight can we gather to verify or challenge this feeling? This was the first major question addressed by the distinguished delegates to the twenty-seventh World Congress of Labour and Social Security Law held at Montevideo, 2'5 September 2003. The aim of the conference was to discover current problems regarding the existing structures and functions of collective bargaining in industrialized countries today'problems readily identifiable in the context of economic globalization, falling union density, the increase in atypical and knowledge-based workers, and the 'tertiarization' or declining economic importance of manufacturing-based industry. This bulletin contains some of the most important papers devoted to this major theme of the conference. It presents twenty national reports, each written by a scholar well-versed in the law and practice of collective bargaining in the country covered. Two introductory reports deal with such general issues as the varying competences of representatives under different legal systems, labor union representation within the public sector, the development of collective bargaining in EC law, the levels and structures of collective bargaining practice, and the widening gap between the relevant legal norms and real situations. The national reports were drafted on the basis of a questionnaire, which appears as an annex. This allows the reader to easily compare the solutions set forth for consideration in the various countries under review. This book assesses the role of employers in the development of welfare state and labour market institutions. Building on an in-depth analysis of Germany, a market economy known to often provide economic benefits to firms, this book explores one of the most contested issues in the comparative and historical literature on the welfare state. In a departure from existing employer-centered explanations, the author applies new empirical data to contend that the variation in acceptance of social reform depends more on changes in the types of political challenges faced by employers, than on changes in the type of institutions considered economically beneficial.
