Das Ziel, die Umsatzsteuersysteme der EU-Mitgliedstaaten zu harmonisieren (4. Erwägungsgrund der Mehrwertsteuer-Systemrichtlinie), wurde mit der Einführung eines gemeinsamen Mehrwertsteuersystems entschieden vorangetrieben. Diese soll der Europäische Gerichtshof (EuGH) anhand des europäischen Rechts einheitlich interpretieren, um bestehende Hemmnisse aus dem Weg zu räumen. Dabei hat die Rechtsprechung des EuGH teilweise erhebliche Folgen auf das nationale Umsatzsteuerrecht der Mitgliedstaaten. Von einer veränderten Rechtsprechung der Gerichte über das Kippen bisheriger Verwaltungspraxis bis hin zu nationalen Gesetzesänderungen – die Auswirkungen der Urteile des EuGH sind deutlich zu spüren. He argues that the law began to change with respect to economic liberties in the late 1930s.
