Man fragte sich nach den Beweggründen, die hinter der Gesetzgebung des angeblich „ersten christlichen Kaisers“ standen. Gerade im Privat- und Familienrecht versuchten einige Historiker einen deutlich christlichen Einfluss zu erkennen, während andere eine Stärkung der traditionellen Werte in ihm sahen. Aber wie verhielt es sich wirklich? War Konstantin bereits so sehr vom christlichen Glauben durchdrungen, dass sich dieser in seiner Gesetzgebung wiederspiegelte? Oder beruhen seine Gesetze vielmehr auf gesellschaftspolitischen Bedürfnissen, die mit Hilfe traditioneller „Rezepte“ erfüllt werden sollten? Mit diesen Fragen beschäftigt sich die vorliegende Arbeit, welche sich jedoch aus Gründen der Umfangsbeschränkung nur auf einen Teil des oben genannten Rechts-Bereiches, nämlich die außerhalb des matrimonium iustum stehenden Beziehungen, das Kontubernium und das Konkubinat konzentriert. Ziel ist es sowohl die konstantinische Gesetzgebung zu diesen Verbindungen als auch die dahinter stehenden Beweggründe und Motive herauszuarbeiten. Dabei soll die Vorgehensweise folgendermaßen aussehen: Zunächst werden die Gesetze zum Kontubernium betrachtet, einer außerrechtlichen Beziehungsform bei der sich mindestens einer der beiden Partner im Sklavenstatus befindet. Hier sollen die beiden Fälle, reines Sklavenkontubernium und Kontubernium zwischen Freien und Sklaven gesondert behandelt werden. Der erste Fall ist hauptsächlich der Vollständigkeit halber aufgenommen worden und wird daher recht knapp gefasst sein, da keiner der Partner eine selbständige juristische Person ist und eine derartige Beziehung außerhalb des Gesetzes stattfindet. Der zweite Fall wird wesentlich umfangreicher sein, da dieser je nach Geschlecht unterschiedlich behandelt werden muss. Der zweite Teil der Arbeit beschäftigt sich dann anschließend mit dem Konkubinat, welches als außerrechtliches, geschlechtliches Zusammenleben zwischen Freien erklärt werden kann. In diesem Kapitel soll zunächst ein kurzer Rückblick auf die ältere Rechtslage diesbezüglich, nämlich in die Zeit des Augustus, gegeben werden, um im Folgenden die konstantinischen Gesetze zum Konkubinat in Bezug auf Neuerungen und Parallelen zu untersuchen. In der abschließenden Schlussbetrachtung werden dann noch einmal die gefundenen Beweggründe und Motive der kaiserlichen Gesetzgebung zu den außerehelichen Verbindungen zusammengefasst.

The two texts presented here are reconstructions of 4th-century chronicles which exist only in ancient translations or in surviving histories. The first text, Chronici canones of Eusebius of Caesarea, is one of the most influential texts of the period but it only survives in two translations and in numerous fragments recorded in other histories. The final part has to be almost completely reconstructed. The second chronicle, The Continuatio Antiochiensis Eusebii , is a history of Antioch between AD 325 and 350 which has to be reconstructed from obscure sources. The reconstructions are presented in Greek with English translations and are accompanied by lengthy commentaries which analyse the value of the reconstruction process.
