Die folgende Arbeit entstand im Zeitraum zwischen Herbst 2013 und Dezember 2017, erfuhr aber zahlreiche Aktualisierungen bis Anfang 2019. In dieser Zeit hat der elektronische Rechtsverkehr in Deutschland einen Sprung von einem kaum bekannten Phänomen zu einem zumindest in der Anwaltschaft allgegenwärtigen Thema gemacht. Der Dreh- und Angelpunkt der Diskussion waren zu Beginn des Gesetzgebungsverfahrens für ein Gesetz zur Förderung des elektronischen Rechtsverkehrs mit den Gerichten zunächst Themen wie der Anschluss- und Benutzungszwang oder das elektronische Empfangsbekenntnis. Heute dreht sich die Diskussion vor allem um das besondere elektronische Anwaltspostfach (beA) mit seinen Vor- und Nachteilen. Durch die Begleitung des Gesetzgebungsprozesses und die Beschäftigung mit dem elektronischen Gerichts- und Verwaltungspostfach (EGVP), das als Grundlage für das beA dient, will ich mit dieser Arbeit einen Beitrag nicht nur zur wissenschaftlichen Durchdringung des elektronischen Rechtsverkehrs, sondern auch zur Versachlichung der Diskussion um eben diesen leisten. Die Arbeit berücksichtigt den Entwicklungsstand von Anfang April 2019, die Quellen wurden (soweit möglich) auf den entsprechenden Stand aktualisiert.

In each instance, the quotidian life of struggle, racial, religious, and social class is seen through the lens of the mighty figures of the period. The works of the period's great figures are shown in the new light of the human search for symbolism, the search for superman, the rise of individualism and decline of history as a source for knowledge. This third volume is painted in dark colors, a foreboding of the world that was to come, of political extremes, and intellectual exaggerations. The author looks forward to a postmodern Europe in which there is a faint glean of light from the other side. What actually appeared was the glare of Nazism and Communism, each claiming the future.

In this provocative monograph, Bertram Malle describes behavior explanations as having a dual nature—as being both cognitive and social acts—and proposes a comprehensive theoretical model that integrates the two aspects. When people try to understand puzzling human behavior, they construct behavior explanations, which are a fundamental tool of social cognition. But, Malle argues, behavior explanations exist not only in the mind; they are also overt verbal actions used for social purposes. When people explain their own behavior or the behavior of others, they are using the explanation to manage a social interaction—by offering clarification, trying to save face, or casting blame. Malle's account makes clear why these two aspects of behavior explanation exist and why they are closely linked; along the way, he illustrates the astonishingly sophisticated and subtle patterns of folk behavior explanations. Malle begins by reviewing traditional attribution theories and their simplified portrayal of behavior explanation. A more realistic portrayal, he argues, must be grounded in the nature, function, and origins of the folk theory of mind—the conceptual framework underlying people's grasp of human behavior and its connection to the mind. Malle then presents a theory of behavior explanations, focusing first on their conceptual structure and then on their psychological construction. He applies this folk-conceptual theory to a number of questions, including the communicative functions of behavior explanations, and the differences in explanations given for self and others as well as for individuals and groups. Finally, he highlights the strengths of the folk-conceptual theory of explanation over traditional attribution theory and points to future research applications.
