Heute, am 23. Mai 1949, beginnt ein neuer Abschnitt in der wechselvollen Geschichte unseres Volkes. Heute wird nach der Unterzeichnung und Verkündung des Grundgesetzes die Bundesrepublik in die Geschichte eintreten.“ Mit diesen feierlichen Worten hat Konrad Adenauer damals die historische Bedeutung der Entstehung des Grundgesetzes (GG) und damit der Bundesrepublik Deutschland vor dem Parlamentarischen Rat gewürdigt. Das Grundgesetz, das vor drei Jahren seinen fünfzigsten Geburtstag feierte, hat sich mittlerweile bewährt wie keine andere Verfassung in der deutschen Geschichte. Dies wird nicht nur von den Deutschen so gesehen, sondern auch im Ausland wurde und wird die Erfolgsgeschichte der deutschen Verfassung in höchstem Maße anerkannt und zum Teil sogar bewundert. In der vorliegenden Arbeit wird der Weg des Grundgesetzes von der deutschen Kapitulation bis zu dessen Ratifizierung durch den Parlamentarischen Rat nachgezeichnet und dabei auf die ausländischen und deutschen Einwirkungen eingegangen. Im ersten Kapitel werden zunächst die historischen Rahmenbedingungen skizziert, innerhalb derer die ersten Ideen für eine deutsche Verfassung geäußert wurden. Der zweite und umfangreichste Teil der Arbeit beschäftigt sich mit den einzelnen Schritten auf dem Weg zum Grundgesetz. Im einzelnen wird dabei der Zeitraum von den Kriegskonferenzen der „Großen Drei“ (USA, Großbritannien und Sowjetunion) bis zur Übergabe der Frankfurter Dokumente behandelt. Im letzten Abschnitt wird zusammenfassend der Frage nachgegangen, ob das Grundgesetz nun – wie so oft behauptet – den Deutschen durch die Westalliierten aufoktroyiert worden sei, oder ob die bundesrepublikanische Verfassung vielmehr eine eindeutig „deutsche Handschrift“ trägt.
