English summary: Guardianship or curatorship ordered in case of physical incapacity is done as a care-giving measure for those concerned, but is at the same time an intervention in their self-determination. The legal requirements for ordering such a guardianship do not, however, take this double function into consideration, and fail to make allowances for the degree to which the capacity for self-determination ought to be restricted. In this work, Karl August Prinz von Sachsen Gessaphe develops a diversified and flexible model for ordering a guardianship and for the reservation of consent, applying this in particular to the extent of the incapacity of self-determination required under the law. German description: Die Betreuung ist fursorgende Hilfe, weil der Betreuer als gesetzlicher Vertreter die Handlungsunfahigkeit des Betreuten uberwindet. Sobald die Betreuung jedoch gegen den Willen des Betreuten erfolgt, greift sie zugleich in sein Selbstbestimmungsrecht ein. Die gesetzliche Eingangsschwelle der Betreuerbestellung wird diesem Doppelcharakter nicht hinreichend gerecht. Eckdaten hierfur sind die multifaktorielle Bedingtheit psychopatologischer Funktionsstorungen und ihrer Auswirkungen auf die Selbstbestimmungsfahigkeit sowie die Vorgaben der Verfassung fur die Erwachsenenfursorge. Mit Hilfe seiner Konzeption der Vorsorgevollmacht konnen Betreuungen weitgehend durch selbstbestimmte Vorsorge vermieden werden. Ausserdem wird deutlich, dass die Geschaftsunfahigkeit zur Konkretisierung des notwendigen Grades eingeschrankter Selbstbestimmungsfahigkeit zu starr ist. Fur Fremdbestimmungsbefugnisse im hochstpersonlichen Bereich ist die entsprechende rechtliche Handlungsunfahigkeit zwingende Schwelle; ansonsten muss man zwischen eingewilligter und ungewollter Betreuung unterscheiden und mit Hilfe der Einsichts- und Steuerungsunfahigkeit eine flexible Schwelle bilden. Fur den Einwilligungsvorbehalt wird der gesetzliche Tatbestand prazisiert.
