En el Derecho español, la pretensión indemnizatoria de la víctima de un daño puede ser decidida por cuatro jurisdicciones diferentes, conforme a las normas procesales propias de cada una de ellas y de acuerdo con reglas materiales de responsabilidad que son, también, diferentes. A la competencia general del orden jurisdiccional civil, se suman las competencias de la jurisdicción penal, la contencioso-administrativa y la social, que son competentes para decidir sobre la pretensión de la víctima del daño en el ámbito objetivo y subjetivo que define sus respectivas competencias y en aplicación de las normas sectoriales cuya observancia tienen encomendada. De esta forma, a la dispersión jurisdiccional se suma la diversidad de reglas de responsabilidad, interpretadas y aplicadas por los jueces y magistrados de cada uno de los órdenes jurisdiccionales potencialmente competentes. El resultado es que daños materialmente idénticos son juzgados por jueces de todos los órdenes jurisdiccionales y conforme a normas materiales diferentes. El trabajo explica los criterios legales de atribución de la competencia jurisdiccional en pleitos de responsabilidad civil extracontractual. Da razón de las dudas que, a pesar de las modificaciones legales en la materia, todavía plantea la identificación del juez competente y del Derecho aplicable en un pleito sobre responsabilidad civil y evidencia los problemas de coherencia que resultan de un sistema diseñado a la medida de los demandados y que no siempre sitúa a la víctima del daño en el centro del debate sobre el Derecho aplicable a su pretensión y el juez que ha de resolverla.
