Una de las disciplinas jurídicas más sensibles a los cambios sociales es, sin duda, el Derecho de daños que se ve afectado no sólo por los cambios legislativos sino también por los cambios tecnológicos y por los cambios en las sensibilidad sociales. Los cambios tecnológicos influyen en la aparición de nuevas formas de dañar, o de nuevos bienes o facetas de la persona que las nuevas tecnologías permiten dañar de manera más eficaz; porque un mundo cada vez más tecnológico, con una tecnología que cada vez maneja fuerzas más impresionantes, es también, sin duda, un mundo en el que anidan más peligros para la persona que, cuando se convierten en daños efectivos, deben ser reparados. Pero no sólo los cambios tecnológicos inciden en el Derecho de daños. También lo hacen los cambios en la sensibilidad social en virtud de los cuales ciertos bienes, como por ejemplo el medio ambiente, van tomando una importancia que lleva a la jurisprudencia (o al legislador) a buscar mecanismos para su defensa. Los estudios que componen este volumen son independientes unos de otros, pero tienen en común el que responden a la sensibilidad que respecto del derecho de daños se tiene en la actualidad. In European law, "non-contractual liability arising out of damage caused to another" is one of the three main non-contractual obligations dealt with in the Draft of a Common Frame of Reference. The law of non-contractual liability arising out of damage caused to another - in the common law known as tort law or the law of torts, but in most other jurisdictions referred to as the law of delict - is the area of law which determines whether one who has suffered a damage, can on that account demand reparation - in money or in kind - from another with whom there may be no other legal connection than the causation of damage itself. Besides determining the scope and extent of responsibility for dangers of one's own or another's creation, this field of law serves to protect fundamental rights in the private law domain, that is to say horizontally between citizens inter se.
