Si se tiene en cuenta la evidente conexión que jurídica y socialmente tiene el Derecho de familia con el Derecho de Sucesiones, la transformación social que la familia ha experimentado en España en las últimas décadas, con el reconocimiento jurídico de unos modelos de convivencia, vínculos y estructuración de las relaciones paterno-filiales sencillamente impensables a finales del siglo XIX cuando se promulgó el Código Civil, debería tener también como resultado una alteración sustancial del derecho sucesorio en relación con la concepción de la titularidad y posesión del patrimonio y su destino para después de la muerte. Más específicamente, cabe afirmar, aunque tal opinión en absoluto es compartida por todos los juristas, que respeto de pocos años anteriores, al menos en un sector cuantitativamente importante de la sociedad española –baste tener en cuenta tan sólo los ciudadanos regidos por la normativa sucesoria de las Comunidades Autónomas con Derecho Civil propio- se han producido un cambio significativo y claramente apreciable en la forma de realizarse-o de intentar realizarse cuando el Código Civil lo permite-las disposiciones mortis causa dentro del entorno familiar más inmediato referido a los hijos, cónyuge, pareja y padres.

Este libro trata de las implicaciones que la fuerte crisis económica ha tenido en el procedimiento de liquidación de la herencia, materia ya de por sí compleja y poco sistematizada, con normas que se hallan dispersas en el Código Civil, la Ley de Enjuiciamiento Civil o la Ley Concursal. Para abordar la cuestión con la profundidad merecida, la autora analiza tanto el fenómeno de la sucesión mortis causa como los recursos que existen para preparar y facilitar la futura liquidación prestando especial consideración a la compleja figura de la herencia yacente, prácticamente huérfana de regulación positiva y origen de incontables problemas. Tras abordar la situación de los llamados a la herencia en lo que se refiere a los efectos y consecuencias del ejercicio positivo (aceptación) o negativo (repudiación) del ius delationis, se estudia la situación de los diferentes tipos de acreedores interesados en la liquidación de la herencia, del causante, del llamado, del ya heredero o del repudiante. Además, a fin de dar la mejor respuesta a los interrogantes planteados por la liquidación hereditaria en los tiempos de crisis, la autora nos acerca a los diferentes sistemas de responsabilidad por deudas así como sus características y efectos. Particular atención se otorga al beneficio de inventario, incidiendo en las cuestiones que, a pesar de su reciente reforma en nuestro Derecho, siguen siendo problemáticas. La parte final del libro aborda la muy interesante y poco tratada cuestión de las llamadas deudas ocultas o sobrevenidas, que son aquellas que aparecen tiempo después de que el heredero haya aceptado la herencia con total desconocimiento de las mismas, profundizando en las consecuencias que tal situación produce tanto a efectos fiscales como civiles.

Intestate Succession is the second volume in the Comparative Succession Law series which examines the principles of succession law from a comparative and historical perspective. This volume discusses the rules which apply where a person dies either without leaving a valid will, or leaving a will which fails to dispose of all of the person's assets. This third volume in a series on Comparative Succession Law concerns the entitlement of family members to override the provisions of a deceased person's will to obtain money or assets (or more money or assets) from the person's estate. Some countries, notably those in the civil law tradition (such as France or Germany), confer a pre-ordained share of the deceased's estate or of its value on certain members of the deceased's family, and especially on the deceased's children and spouse. Other countries, notably those in the common law tradition (such as England, Canada, or Australia), leave the matter to the discretion of the court, the amount awarded depending primarily on financial need. Whichever form it takes, mandatory family provision is both a protection against disinheritance and also, therefore, a restriction on testamentary freedom. The volume focuses on Europe and on countries influenced by the European experience. The repudiation of the inheritance is the rejection of the condition of title or status as heir, and of everything to which it was named by the deceased, or the law. It is an act that is of great importance to the respondent and others involved in the succession: cosucesores, substitutes appointed by the deceased and to the creditors. And also, in regard to the transfer of property mortis causa because it involves an alteration or change the destination of those initially expected by the deceased or by law. What is worse when it comes to goods that belonged in a secular or a family immemorial and passed from hand to hand, generation to generation, because it is a failure or rupture in the order of succession as it disrupts the iter way or path, not normal, but we could even say that, naturally have to take these goods.
