La obra que presenta Ediciones UC es la primera recopilación comentada de legislación eclesiástica chilena. Los temas forman parte del llamado Derecho Eclesiástico (también conocido como “Derecho Eclesiástico del Estado”), que - según se acepta – tiene por objeto el estudio de las normas jurídicas emanadas del estado y que se refieren al fenómeno religioso en su conjunto. Teniendo en cuenta el importante rol que cumple el Estado laico en un sistema democrático, en relación con su deber de reconocer, respetar y proteger los derechos de personas y grupos en materia religiosa, la recopilación del Derecho Eclesiástico Chileno –cuyos preceptos son comentados y concordados por el Centro de Libertad Religiosa de la Pontificia Universidad Católica de Chile – da a conocer la forma en que nuestro ordenamiento jurídico se preocupa sobre la materia. Así, considera en primer lugar una introducción referida a la “Libertad Religiosa en Chile”, incluyendo luego no sólo la transcripción de la legislación dedicada especialmente a la materia, sino también numerosas otras reglas que, contenidas en cuerpos de diferente jerarquía, se relacionan a si mismo con ella. De este modo, la obra se convierte en un completo e invaluable instrumento para quien desee investigar esta temática, al comprender normas de nuestra Constitución Política y vinculadas al ámbito religioso de la persona humana, diversas convenciones y declaraciones internacionales; las reglas de la ley Nº 19.638 sobre la constitución jurídicas de las Iglesias y organizaciones religiosas; diversas disposiciones legales contenidas en los Códigos Civil; Penal, del Trabajo, Sanitario, Orgánico de Tribunales, de Procedimiento Civil, Procesal Penal y de Procedimiento Penal que se relacionan con la materia, para terminar con un catálogo de obras doctrinales publicadas especialmente en Chile, sobre el Derecho Eclesiástico y la Libertad Religiosa. What is the place assigned to religion in the constitutions of contemporary States? What role is religion expected to perform in the fields that are the object of constitutional regulation?
