En este trabajo se intenta aportar algunas reflexiones sobre el modelo jurídico establecido en materia religiosa en Colombia, el cual fue construido primordialmente por la jurisprudencia constitucional. Se pretende demostrar que, pese a que la Corte defiende el carácter laico del Estado, la misma jurisprudencia constitucional ha permitido que la Iglesia católica conserve algunos de los privilegios de que gozaba antes de 1991. Por otra parte, algunos beneficios de la Iglesia católica han sido extendidos a otras congregaciones en aras de garantizar la igualdad de todas. Sobre este punto se intentará justificar que esta estrategia atenta contra el carácter laico del Estado ya que privilegia injustificadamente el fenómeno religioso. Lo anterior hace que el modelo de laicidad establecido por vía jurisprudencial se asemeje más a un Estado pluriconfesional que a uno laico, dado que algunos de los privilegios de la Iglesia católica no se han eliminado, sino que se han extendido a las demás congregaciones.

Secularism: the definition of this word is as practical and urgent as income inequalities or the paths to sustainable development. In this wide-ranging analysis, Jocelyn Maclure and Charles Taylor provide a clearly reasoned, articulate account of the two main principles of secularism—equal respect, and freedom of conscience—and its two operative modes—separation of Church (or mosque or temple) and State, and State neutrality vis-à-vis religions.
