"¿Por qué un libro entero sobre la sucesión? La sucesión mortis causa regula la atribución de bienes después de la muerte. La disciplina de sucesión satisface así dos intereses complementarios: – El interés privado del difunto en cuanto a disponer de sus bienes por el tiempo que deja de vivir, y – El interés público del Estado de que, tras la muerte del sujeto, los activos no se conviertan en res nullius. Desde que el mundo es mundo, el hombre ha tenido la aspiración ilusoria de dejar algo de sí mismo más allá de la muerte, deshacerse de los bienes y dictar disposiciones, como si todo esto sirviera para dejar un profundo rastro en las generaciones venideras. Por otro lado, el Estado tiene interés en evitar que los ciudadanos ad arma ruant tomen posesión de bienes relictos, creando así conflictos y desorden social. Para el estado, la regulación de la sucesión es una cuestión de orden público. Para el particular, la satisfacción de un interés personal y material. Y el derecho de sucesiones satisface y protege un tercer interés: el interés de la familia. La disciplina de sucesiones, como veremos, sanciona el reconocimiento de la familia como organización social y económica- Se puede afirmar que en el derecho cubano la mera existencia de una relación de parentesco con el fallecido (matrimonio, descendencia, ascendencia) no es suficiente para la atribución de la cualidad de legitimario o, más precisamente, de heredero especialmente protegido. De hecho, además de la relación familiar con el causante, se necesitan dos requisitos importantes: que la persona no esté apta para trabajar y que sea económicamente dependiente del causante. No es casualidad que en el derecho cubano se prefiera a la expresión legitimarios la de herederos especialmente protegidos, con la que se pretende resaltar que el ordenamiento jurídico no se limita a proteger a los sujetos sólo por su vínculo familiar, sino cuando existen circunstancias que justifican la especial protección que el ordenamiento jurídico les reserva."
