La enseñanza del derecho internacional público en América Latina se caracteriza actualmente por tres intuiciones centrales: (a) que es "bueno"; (b) que es "derecho" —y si lo es o no es una pregunta importante—; y, finalmente, (c) que constituye un "sistema". Veamos brevemente en qué consiste cada una de esas intuiciones. Comencemos por la idea de que el derecho internacional es "bueno". Esta idea, por supuesto, no aparece generalmente expresada en esos términos. Sin embargo, la narrativa que subyace en gran parte de los manuales de derecho internacional de la región es que los Estados son egoístas y buscan satisfacer sus intereses de manera violenta. Entra, entonces, el derecho internacional a facilitar la cooperación armónica entre Estados, imponiendo la razón de la comunidad internacional a la irracionalidad de los intereses estatales, y protegiendo valores universales como la dignidad humana o los derechos humanos. Es natural que esta idea haya prosperado en América Latina. En una región donde los Estados han mostrado, con frecuencia, su incapacidad (o su abierta falta de voluntad) para proteger a sus ciudadanos, resulta lógico que sea atractiva la idea de que ese Estado incompetente o represor no es la última autoridad, o de que hay una moralidad superior a la que el Estado debe someterse. El derecho internacional funcionaría como esa autoridad superior, que trae justicia donde el Estado la niega.
