Este libro realiza un pormenorizado estudio de la Ley 41/2002 sobre derechos del paciente, información y documentación clínica. Una norma que ha obligado a modificar numerosos aspectos en los centros hospitalarios en cuanto a documentación clínica y protocolos de consentimiento informado.Después de analizar el estado actual del problema de la responsabilidad médica y hospitalaria en el apartado "consideraciones preliminares"{ la obra del profesor Domínguez comenta, uno por uno, cada artículo de la mencionada Ley 41/2002, realizando un breve análisis de sus antecedentes legislativos, su relación con la normativa sanitaria existente (básicamente la Ley General de Sanidad) y las diversas Leyes autonómicas dictadas sobre esta materia. Además, se recoge la opinión de la doctrina y la jurisprudencia del Tribunal Supremo, los Tribunales Superiores de Justicia de las CC.AA. y las Audiencias Provinciales.El comentario sigue la misma sistemática que la Ley 41/2002. Por ello tiene como ejes fundamentales el estudio de los derechos y obligaciones de los pacientes y de los profesionales sanitarios{ el análisis de los preceptos dedicados al derecho a la información y al consentimiento informado, y las consecuencias jurídicas de su omisión en cada supuesto{ las disposiciones relativas a la historia y documentación clínica, con toda la problemática del acceso a la misma, el respeto a la intimidad de los datos sanitarios, y la normativa sobre protección de datos.
