Constatant qu’aucune étude n’opposait les notions de fait du créancier et de faute de la victime, M. Le Magueresse eut l’ambition de confronter la responsabilité délictuelle et la défaillance contractuelle à cet égard. L’observation de départ est que le fait du créancier et la faute de la victime sont fréquemment confondues en jurisprudence, tant dans le domaine de la garantie contre les vices cachés que dans celui de l’obligation de sécurité et de l’acceptation des risques, ou encore au sein des contentieux de la résolution et de l’exception d’inexécution. Le but de sa démarche fut de démontrer que, bien qu’amalgamés en jurisprudence et en doctrine, ces mécanismes exonératoires signalent des spécificités propres à leur domaine. La notion de victime fautive ne doit être utilisée que dans le domaine délictuel, puisqu’à ses yeux le terme de victime présuppose un dommage corporel. La notion de fait du créancier, à l’instar de la faute de la victime, n’est véritablement adaptée qu’au régime de la défaillance contractuelle. Pour lui, cette expression ne doit être employée que lorsque le créancier d’une obligation contractuelle inexécutée a contribué, par son fait ou par sa faute, à l’inexécution ou à la mauvaise exécution de l’obligation de son débiteur...

L'obligation est un lien de droit permettant au créancier d'exiger du débiteur une prestation, positive ou négative. Le contrat est quotidiennement à la source d'obligations : vente, échange, louage, dépôt, prêt... Et nombre de questions se posent, concernant ses conditions et ses effets, les parties, les tiers et la société tout entière. Le législateur intervient souvent au secours du débiteur. Les obligations extra-contractuelles naissent le plus fréquemment d'accidents, longtemps liés à des fautes commises et connues, inhérents de plus en plus, par l'ampleur des dommages et l'exigence de réparation, à une société qui change. Mais si la loi intervient, c'est surtout au secours du créancier. Les obligations sont soumises à des règles communes : le régime général des obligations. Depuis la dernière édition, la jurisprudence et la doctrine ont été très "productives". Constituant la " grammaire " du droit, le droit des obligations est la voie royale de la compréhension du juridique. L'ordonnance en date du 10 février 2016, ratifiée par une loi du 20 avril 2018, a en effet réformé le droit commun des contrats et le régime général des obligations. Les ordonnances du 15 septembre 2021 et la loi du 14 février 2022 sur le statut de l'entrepreneur individuel ont aussi des incidences, mais très ponctuelles. On pourra donc y découvrir les premières applications de ce droit nouveau, notamment la question des clauses abusives ou des violences économiques. Quant à la partie de la responsabilité, elle abordera le préjudice écologique, ainsi que l'actualité très riche sur les produits défectueux en droit des contrats. What view of man did the French Revolutionaries hold? Anyone who purports to be interested in the "Rights of Man" could be expected to see this question as crucial and yet, surprisingly, it is rarely raised. Through his work as a legal historian, Xavier Martin came to realize that there is no unified view of man and that, alongside the "official" revolutionary discourse, very divergent views can be traced in a variety of sources from the Enlightenment to the Napoleonic Code. Michelet's phrases, "Know men in order to act upon them" sums up the problem that Martin's study constantly seeks to elucidate and illustrate: it reveals the prevailing tendency to see men as passive, giving legislators and medical people alike free rein to manipulate them at will.
