O livro “Saneamento Básico: Desafios Legais no Brasil” apresenta uma análise crítica dos problemas que afetam a sociedade, especialmente no que diz respeito aos instrumentos que garantem os direitos fundamentais da pessoa humana. Destaca-se que esta obra adota uma perspectiva analítica que explora a realidade social por meio de discussões embasadas em recortes analíticos e debates nos campos epistemológicos do Direito. Para atender aos objetivos estabelecidos, o livro está organizado em cinco capítulos. Quanto à metodologia adotada, caracteriza-se por uma pesquisa de natureza qualitativa, exploratória, descritiva e explicativa. Utilizou-se uma abordagem metodológica que permitiu investigar as nuances da realidade social por meio de revisão documental e bibliográfica. No primeiro capítulo, denominado “Direito Fundamental ao Saneamento Básico e o Novo Marco Legal do Setor: Análise da Jurisprudência do Supremo Tribunal Federal”, é realizada uma análise doutrinária e jurisprudencial das decisões dos tribunais acerca do recente marco legal do saneamento, com foco nas decisões emitidas pelo Supremo Tribunal Federal (STF) referentes à legislação relativa ao saneamento básico. No segundo capítulo, “Desafios e Implicações da Nova Lei de Licenciamento Ambiental no Brasil”, propõe analisar de forma aprofundada das transformações e obstáculos que surgem com a implementação da nova legislação de licenciamento ambiental, dentro do cenário do desenvolvimento sustentável no Brasil. Em seguida, no terceiro capítulo intitulado “Saneamento e Licenciamento Ambiental: Impactos Legais, Sociais e Econômicos Diante das Alterações Legislativas”, busca-se compreender de que forma as mudanças na legislação reconfiguram o panorama do saneamento e do licenciamento ambiental no Brasil, levando em conta os desafios e as oportunidades que surgem nesse cenário em evolução. No quarto capítulo, nomeado “Nova Legislação Ambiental e de Saneamento no Brasil: Análise sob a Ótica Jurídica e Socioambiental”, investiga-se o cruzamento entre o direito ambiental, a legislação de saneamento básico e a busca pela justiça social, por meio de uma análise das mais recentes alterações legislativas no contexto brasileiro. In the wake of the recognition of the Whanganui River in New Zealand, the Ganges and Yamuna Rivers in India, the Yarra River in Australia and the Atrato River in Colombia as «subjects of rights», the International Observatory on Nature’s Rights has initiated a reflection on the possibility of recognizing the St. Lawrence River, the «path that walks» as it is called by the First Nations, as a «legal person». The texts in this collective work deal with the implications of attributing a legal personhood and rights to the St. Lawrence River, delve into the epistemological foundations of the paradigm of the recognition of the rights of Nature and present concrete cases of recognition of rivers as subjects of law. Written by experts from several countries where the recognition of the legal personhood of rivers has occurred to date, they take an in-depth look at the challenges and contributions of this paradigm shift in river protection. This book answers questions about the implications of such recognition and contributes to the process of building a new law that has just begun in Quebec and Canada with the adoption in February 2021 of resolutions conferring the status of «legal person» on the MagPie/ Muteshekau Shipu River located on the North Shore of Quebec and on the Nitassinan (ancestral territory) of two Innu communities, Ekuanitshit and Uashat mak Mani-utemam.
