This book addresses key questions around gender-sensitive legislation as a key output of gender sensitive Parliaments and explores practical ways to promote gender-sensitive ex-ante scrutiny of legislation, improve implementation through gender responsive budgeting, assess the gender impact of legislation ex post and express laws in gender inclusive ways. All laws have a gender, and the gender of the law can reveal itself in the language, the content and the results of legislation. Gender-blind laws can discriminate directly or indirectly against individuals or population groups, can produce unwanted effects, can reproduce gender stereotypes, and can render laws and policies ineffective. Gender-sensitive legislation on the other hand, can be expected to achieve its desired legislative objectives without unwanted differential impact on the grounds of gender and other individual characteristics and can simultaneously promote gender equality. This book advances the premise that gender sensitive legislation is not the result of political will or good intentions alone but the outcome of gender-sensitive legislative decision-making throughout the life cycle of legislation. This means that gender concerns need to be an integral part of the processes of legislative design and drafting, ex-ante and ex-post legislative scrutiny and implementation of legislation. The volume is divided into four parts. The first part comprises chapters discussing the historical background, policy considerations, and different CFC approaches that have been implemented in domestic legislation. While the chapters included in the second part focus on the recommendation for the effective design of CFC rules found in BEPS Action 3, the chapters encompassed in the third part analyse the implementation of these criteria in Articles 7 and 8 of the ATAD and the compatibility of these provisions with EU primary law. Finally, the chapters encompassed in part four deal with selected issues related to CFC rules, including the compatibility of CFC legislation and tax treaties, the relationship between these rules and general anti-abuse rules, the implications of the proposed CCCTB Directive on CFC rules, alternative approaches to CFC legislation (such as the Global Anti-Base Erosion proposal of the OECD/G20), the interrelationship between CFC rules and transfer pricing legislation, and the balance between effective CFC rules and compliance burdens.

International and national legal frameworks governing the trade and use of pesticides have undergone significant changes over the last twenty years. The International Code of Conduct on the Distribution and Use of Pesticides, the Rotterdam Convention, the Stockholm Convention, the Basel Convention and the Montreal Protocol are only some of the binding and non-binding international instruments applicable to part or all of the life cycle of a pesticide. Specific guidelines for implementation are often available from the secretariat of the applicable international instrument, but comprehensive guidance is generally lacking. Governments need a clear picture of their international obligations as well as guidance on the accepted international consensus on the proper management of pesticides. Upgraded national legislation is needed to align national frameworks with international norms. This text aims to provide governments wishing to design, reform or update their national legislation with up-to-date advice on all aspects of pesticide management. Although the recommendations for national legislative change are designed to be useful to all countries, the text highlights the particular problems faced by developing countries and countries in transition, offering practical solutions to common problems.
