La presente obra ayuda al jurista práctico a resolver las cuestiones principales de Derecho internacional privado europeo respecto a los regímenes económicos matrimoniales. En ella se presentan y proponen soluciones a los distintos problemas que se plantean en relación con los efectos económicos del matrimonio cuando los cónyuges tienen distinta nacionalidad, domicilio o residencia habitual, sobre la base del Reglamento europeo 2016/1103. Dicho Reglamento regula la competencia judicial internacional de los órganos jurisdiccionales de los Estados miembros, que han participado en la cooperación reforzada, cuando se les plantea un litigio sobre las consecuencias económicas de un matrimonio con elemento extranjero; los efectos extraterritoriales de las resoluciones y documentos de un Estado de la Unión Europea sobre la materia, así como la determinación de la ley aplicable al fondo del asunto. Siendo el tema principal de este trabajo el análisis de esta cuestión —qué leyes entre la vinculadas al matrimonio pueden elegir o aplicar los cónyuges en el ámbito europeo—, nos ha parecido de interés práctico añadir una segunda parte en la que se aborde el mismo problema dentro del ámbito del Estado español. La coexistencia en España de distintos ordenamientos jurídicos que regulan la economía del matrimonio, origina conflictos interregionales o intraestatales para los que también hay que encontrar respuestas.
