Queering the Public Sphere in Mexico and Brazil is a groundbreaking comparative analysis of the historical development and contemporary dynamics of LGBT activism in Latin America’s two largest democracies. Rafael de la Dehesa focuses on the ways that LGBT activists have engaged with the state, particularly in alliance with political parties and through government health agencies in the wake of the AIDS crisis. He examines this engagement against the backdrop of the broader political transitions to democracy, the neoliberal transformation of state–civil society relations, and the gradual consolidation of sexual rights at the international level. His comparison highlights similarities between sexual rights movements in Mexico and Brazil, including a convergence on legislative priorities such as antidiscrimination laws and the legal recognition of same-sex couples. At the same time, de la Dehesa points to notable differences in the tactics deployed by activists and the coalitions brought to bear on the state. De la Dehesa studied the archives of activists, social-movement organizations, political parties, religious institutions, legislatures, and state agencies, and he interviewed hundreds of individuals, not only LGBT activists, but also feminists, AIDS and human-rights activists, party militants, journalists, academics, and state officials. He marshals his prodigious research to reveal the interplay between evolving representative institutions and LGBT activists’ entry into the political public sphere in Latin America, offering a critical analysis of the possibilities opened by emerging democratic arrangements, as well as their limitations. At the same time, exploring activists’ engagement with the international arena, he offers new insights into the diffusion and expression of transnational norms inscribing sexual rights within a broader project of liberal modernity. Desde os tempos mais remotos, a intermediação financeira se tornou uma necessidade básica para manutenção das relações de consumo. Assim os bancos, possuem papel fundamental na intermediação financeira entre poupadores e tomadores de recursos. Assim, no Brasil, essa relação se demonstrou evidenciada em relação consumerista, e com o tempo, as demandas revisionais bancárias se multiplicaram, e com elas os desafios jurisdicionais, em especial para o juiz. Tratam de elementos contratuais muito próprios e com efeitos contábeis muitas vezes de dificílima compreensão, exigindo conhecimento técnico para além da esfera jurídica. Neste ponto surge sob inarredável importância, além de algum aprofundamento nos ditames do mercado de financiamento, a atuação do perito. A relação cliente-banco é formada por meio de contratos abalizados pelo sistema protetivo do consumidor, com a qual o legislador intencionou equilibrar a relação de consumo. Entretanto, na prerrogativa legal de parte vulnerável da relação, o cliente possivelmente ingressa com ação revisional e factível má-fé, com a finalidade de protelar a dívida. Partindo premissa de que o abuso do direito é um ato ilícito, o livro aborda a possibilidade de abusos do consumidor na relação cliente-banco pelo uso malicioso das ações revisionais, a consequência gerada para a coletividade desta factível prática e a influência do laudo pericial no resultado da sentença. Wendy Hunter explores civil-military relations in Brazil following the transition to civilian leadership in 1985. She documents a marked, and surprising, decline in the political power of the armed forces, even as they have remained involved in national policy making. To account for the success of civilian politicians, Hunter invokes rational-choice theory in arguing that politicians will contest even powerful forces in order to gain widespread electoral support. Many observers expected Brazil's fledgling democracy to remain under the firm direction of the military, which had tightly controlled the transition from authoritarian to civilian rule. Hunter carefully refutes this conventional wisdom by demonstrating the ability of even a weak democratic regime to expand its autonomy relative to a once-powerful military, thanks to the electoral incentives that motivate civilian politicians. Based on interviews with key participants and on extensive archival research, Hunter's analysis of developments in Brazil suggests a more optimistic view of the future of civilian democratic rule in Latin America.

This book grew out of a major European Union (EU) funded project on the Hague Maintenance Convention of 2007 and on the EU Maintenance Regulation of 2009. The project involved carrying out analytical research on the implementation into national law of the EU Regulation and empirical research on the first year of its operation in practice. The project also engaged international experts in a major conference on recovery of maintenance in the EU and worldwide in Heidelberg in March 2013. The contributions in this book are the revised, refereed and edited versions of the best papers that were given at the conference. The book is divided into four parts: (i) comparative context (ii) international, looking at national and non-European regional practice and how the Hague Convention could change things; (iii) international and the EU, looking at issues covered by both the Hague Convention and the EU Regulation; and (iv) the EU - looking at the Maintenance Regulation. This is the first study to look carefully at both of the new cross-border maintenance regimes globally and in Europe and to begin the examination of the practical operation of the latter regime. The approval of the Hague Convention by the EU on 9 April 2014 is a major step forward for its practical significance in enabling the recovery of child and spousal support, as from 1 August 2014 all of the 28 EU Member States apart from Denmark will be bound by the Convention.

Uma das questões mais polêmicas acerca da aplicação da técnica do recurso per saltum na jurisdição trabalhista está em definir se o tribunal deve examinar os demais pedidos quando reforma a sentença que declarou não existir relação jurídica de emprego. Ou se deve determinar, reconhecida a relação de emprego pelo tribunal, o retorno dos autos do processo ao juízo originário para o juiz singular julgar os demais pedidos decorrentes do reconhecimento da relação jurídica de emprego cuja existência a sentença negara. Noutras palavras, trata-se de saber se a técnica do salto de um grau de jurisdição aplica-se à hipótese em que o tribunal, reformando a sentença, declara a existência da relação de emprego que não fora reconhecida no primeiro grau de jurisdição.
