Die Datenschutz-Grundverordnung hat das Prinzip der rechtlichen Selbstverantwortung gesetzlich in Art. 5 i.V.m. Art. 24 DSGVO verankert und den Normadressaten mit den datenschutzrechtlichen Instrumenten der Verhaltensregeln nach Art. 40 und 41 DSGVO, der Zertifi zierung nach Art. 42 und 43 DSGVO und der Datenschutz-Folgenabschätzung nach Art. 35 und 36 DSGVO die Möglichkeit gegeben, ihrer übertragenen Selbstverantwortung nachzukommen. Diese datenschutzrechtlichen Instrumente können die Umsetzung der Datenschutz-Grundverordnung in der Praxis erleichtern und verbessern. Zugleich besteht jedoch die Gefahr, dass diese Instrumente missbraucht werden könnten und es in der Folge zu einer Beeinträchtigung von Grundrechten betroffener Personen kommt. Dieses Buch stellt diese Selbstregulierungs- und Selbstkontrollinstrumente der Datenschutz-Grundverordnung vor, bewertet sie aus rechtsdogmatischer, rechtstheoretischer und empirischer Perspektive hinsichtlich ihrer Potenziale und Defizite und unterbreitet daran anknüpfend rechtspolitische Vorschläge, um sie konzeptionell weiterzuentwickeln.

Die Projektgruppe verfassungsverträgliche Technikgestaltung führt interdisziplinäre Forschungsprojekte zu Rechtsfragen der Informations- und Kommunikationstechniken durch, die die Ziele verfolgen, Technik rechtsverträglich zu gestalten und Recht technikadäquat fortzuentwickeln. 1988 als provet e. V. in Darmstadt gegründet, siedelte die Gruppe 1998 an die Universität Kassel um. Seitdem ist provet eine Forschungsgruppe am Lehrstuhl von Prof. Dr. Roßnagel an der Universität Kassel und seit 2005 auch eine Abteilung im Wissenschaftlichen Zentrum für Informationstechnik-Gestaltung (ITeG) der Universität Kassel. Der provet e. V. existiert parallel dazu weiter. Im Mai 2018 trat Prof. Dr. Gerrit Hornung als wissenschaftlicher Leiter hinzu. Dieser Band zeichnet die Entwicklung der Projektgruppe nach und will dabei auch als Impulsgeber für ähnliche Vorhaben an anderen Einrichtungen sein.

The ever increasing relevance of European law which involves replacement or supplementation of and interaction with national law not only affects the states in Europe but also, and foremost, the citizens. The rights of the citizens in Europe are protected by the European Fundamental Rights and Freedoms. The aim of this textbook is to grasp and illustrate the meaning of these rights and to integrate it into a coherent system. For this purpose the book not only deals with the pertinent law of the European Union and the European Community, but also with the European Convention for the Protection of Human Rights and Fundamental Freedoms which, too, is becoming more and more important. In addition, regard is had to the Charter of Fundamental Rights of the Union which forms part of the Treaty establishing a Constitution for Europe. Although the Charter is not yet legally binding since the Constitution has not been ratified by all EU Member States, the Community Courts already make reference to it as a concentrate of the constitutional traditions common to the Member States. It therefore does not seem entirely unlikely that the Charter might be included into the existing Treaties irrespective of the future constitutional developments on the EU level. On a similar anticipatory basis the book also takes into account those Protocols to the European Convention for the Protection of Human Rights and Fundamental Freedoms that have not yet entered into force.

This book examines what makes accountability for previous violations more or less possible for transitional regimes to achieve. It closely examines the other vital goals of such regimes against which accountability is often balanced. The options available are not simply prosecution or pardon, as the most heated polemics of the debate over transitional justice suggest, but a range of options from complete amnesty through truth commissions and lustration or purification to prosecutions. The question, then, is not whether or not accountability can be achieved, but what degree of accountability can be achieved by a given country. The focus of the book is on the politics of transition: what makes accountability more or less feasible and what strategies are deployed by regimes to achieve greater accountability (or alternatively, greater reform). The result is a more nuanced understanding of the different conditions and possibilities that countries face, and the lesson that there is no one-size-fits-all prescription that can be handed to transitional regimes.
