Nach ihrer Einbindung und Verstrickung in das NS-Regime unternahm die deutsche Anwaltschaft 1945 einen neuen Aufbruch in die freie Advokatur. Starke Rechtszersplitterung durch die und innerhalb der Besatzungszonen hat dies erschwert. Interessenkonflikte zwischen den heimischen Anwälten und denen, die als Flüchtlinge oder Berufsfremde in die Anwaltschaft strebten, führten zu mancher Zerreißprobe. Begehrlichkeiten neuer politischer Einbindung in den Zeiten des kalten Krieges wurden im Westen mühsam abgewehrt. Unter der Herrschaft der sozialistischen Machthaber gelang dies im Osten nicht. Das Buch beschreibt jedoch, wie ostdeutsche Anwälte sich gleichwohl in beachtlichem Umfang Möglichkeiten echter Interessenvertretung ihrer Mandanten bewahrt haben. Im Westen war die erst 1959 erreichte Bundesrechtsanwaltsordnung nur ein erster Schritt. Weder die Politik noch die Anwaltschaft hatten voll erfasst, was unter der Geltung des Grundgesetzes freier Beruf und freie Advokatur bedeuten, nicht nur Freiheit von staatlicher Intervention, sondern auch Freiheit von einer Bevormundung durch die anwaltliche Selbstverwaltung, wo Gründe des Gemeinwohls diese nicht gebieten. Das Buch zeigt, wo und wie Anwälte erst lernen mussten, freie Advokatur zu leben und wie sehr von einem positiven Umgang damit die Zukunft der Anwaltschaft abhängt. Es zeigt auch, wie es nach 1990 gelungen ist, dass aus der Anwaltschaft in West und Ost eine deutsche Anwaltschaft entsteht.
