Dieser Band analysiert die französische Form der Umsetzung, die sich durch eine einheitlich-verwaltungsrechtliche Qualifikation von Vergabeverträgen und eine weitgehend unterschiedslose Anwendung spezifisch-vergaberechtlicher Rechtsbehelfe im Ober- und Unterschwellenbereich auszeichnet. Dominik Römling bewertet das französische Vergabeprozessrecht im Lichte der unionsrechtlichen Vorgaben und stellt seine wesentlichen Eigenschaften den strukturprägenden Merkmalen des deutschen Vergaberechts und -rechtsschutzes vergleichend gegenüber. The requirements for the award of public contracts and for legal protection under public procurement law are largely determined by EU law. The implementation of these requirements in the EU member states, however, takes place in a wide variety of forms. This study analyzes the French form of implementation, which is characterized by a uniform administrative law qualification of procurement contracts and a largely indiscriminate application of procurement law remedies both above and below thresholds. French public procurement procedural law is evaluated in the light of the requirements of European Union law; in addition, its essential characteristics are compared with the structural features of German public procurement law and legal protection.

Als Vergleichspol fungiert auch das sich noch nicht gefestigte Modell des Verwaltungsvertrags im EU-Eigenverwaltungsrecht (Verwaltungsvertrag der EU-Organe), dessen Dogmatik die Autorin weiterentwickelt. Auf einer zweiten Ebene werden die Wechselwirkungen zwischen den verschiedenen Schichten des EU-Rechts (nationales Recht, Unionsverwaltungsrecht und EU-Eigenverwaltungsrecht) untersucht. Daraus ergeben sich rechtsordnungs- und rechtsebenenübergreifende Strukturmerkmale einer "europäischen Handlungsform" des Verwaltungsvertrags.
